STATUTORY RULES AND ORDERS. 1935. No. 661.

IRISH LIGHTS COMMISSIONERS (ADAPTATION) ORDER, 1935.

WHEREAS it is enacted by Section 2 of the Adaptation of Enactments Act, 1931 (No. 34 of 1931), that the Executive Council may from time to time by order make all such general or specific adaptations of or modifications in any Irish Statute having the force of law in Saorstát Eireann as are, in the opinion of the Executive Council, necessary to enable such statute to have full force and effect in Saorstát Eireann :

AND WHEREAS the Act of the Parliament of Ireland passed in the year 1786 and entitled " An Act for Promoting the Trade of Dublin, by rendering its Port and Harbour more commodious " (26 Geo. III, c. xix), is an Irish Statute within the meaning of the said Adaptation of Enactments Act, 1931 , and has the force of law in Saorstát Eireann :

AND WHEREAS in the opinion of the Executive Council the adaptations intended to be made by this Order of the said Act of the Parliament of Ireland are necessary in order to enable such Act to have full force and effect in Saorstát Eireann :

NOW, the Executive Council, in exercise of the powers conferred on them by Section 2 of the Adaptation of Enactments Act, 1931 (No. 34 of 1931), and of every and any other power them in this behalf enabling do hereby order as follows :—

1. This Order may be cited as the Irish Lights Commissioners (Adaptation) Order, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order the expression " the Act " means an Act of the Irish Parliament passed in the year 1786 (26 Geo. III, c. xix) and entitled " an Act for Promoting the Trade of Dublin, by rendering its Port and Harbour more commodious. "

4. Section 9 of the Act shall be construed and have effect as if—

(a) the words " the Executive Council " were substituted for the words " the Lord Lieutenant, or other Chief Governor or Governors and the Privy Council of this Kingdom for the time being " now contained therein, and

(b) the words " the Secretary of the Executive Council " were substituted for the words "the Clerk of the Privy Council " now contained therein, and

(c) the words " the Executive Council " were substituted for the words " the said Lord Lieutenant, or Chief Governor or Governors and Privy Council. "

5. Section 10 of the Act shall be construed and have effect as if—

(a) the words " the Executive Council " were substituted for the words " the said Lord Lieutenant, or other Chief Governor or Governors and Privy Council for the time being " now contained therein, and

(b) the words " the Executive Council " were substituted for the words " such Lord Lieutenant, or Chief Governor or Governors and Privy Council " now contained therein.

6. Section 11 of the Act shall be construed and have effect as if the words Iris Oifigiúil were substituted for the words Dublin Gazette now contained therein.

7. Section 13 of the Act shall be construed and have effect as if—

(a) the words " the Executive Council " were substituted for the words " the Lord Lieutenant, or Chief Governor or Governors and Privy Council of this Kingdom for the time being " now contained therein, and

(b) the words " the Secretary of the Executive Council " were substituted for the words " the Clerk of the Privy Council " now contained therein, and

(c) the words " the Executive Council " were substituted for the words " the said Lord Lieutenant, or Chief Governor or Governors and Privy Council " now contained therein, and

(d) the words " the Executive Council " were substituted for the words " the Lord Lieutenant, or Chief Governor or Governors and Privy Council " now contained therein.

8. Section 14 of the Act shall be construed and have effect as if—

(a) the words " the Executive Council " were substituted for the words " the said Lord Lieutenant, or Chief Governor or Governors and Privy Council for the time being " now contained therein, and

(b) the words " the Executive Council " were substituted for the words " such Lord Lieutenant, or Chief Governor or Governors and Privy Council " now contained therein.

9. Section 69 of the Act shall be construed and have effect as if the words " the Executive Council " were substituted for the words " the Lord Lieutenant, or Chief Governor, or Privy Council for the time being " now contained therein.

10. Section 81 of the Act shall be construed and have effect as if—

(a) the words " the High Court of Justice " were substituted for the words " His Majesty's Court of Chancery in this Kingdom " now contained therein, and

(b) the words " of Chancery " (where those words occur in the expression " as the said Court of Chancery shall judge fit ") were omitted therefrom.

11. Section 82 of the Act shall be construed and have effect as if the words " Central Office of the High Court of Justice " were substituted for the words " Rolls-Office of the said Court of Chancery " now contained therein.
