STATUTORY RULES AND ORDERS. 1935. No. 555.

IRISH NATIONALITY AND CITIZENSHIP REGULATIONS, 1935.

WHEREAS it is enacted by sub-section (1) of Section 28 of the Irish Nationality and Citizenship Act, 1935 (No. 13 of 1935), that the Minister for Justice may by order make regulations in relation to any matter or thing referred to in the said Act as prescribed or to be prescribed, but that no such regulation shall be made in relation to the amount or collection of fees without the consent of the Minister for Finance:

AND WHEREAS the matters and things to which these regulations relate are matters and things which are referred to in the said Act as prescribed or to be prescribed:

NOW, I, P. J. RUTTLEDGE, Minister for Justice, in exercise of the powers conferred on me by the Irish Nationality and Citizenship Act, 1935 (No. 13 of 1935), and of every and any other power me in this behalf enabling and, in so far as these regulations relate to the fixing of any fees, with the consent of the Minister for Finance testified by his signature hereto, do hereby order and make the following regulations:—

1. These Regulations may be cited as the Irish Nationality and Citizenship Regulations, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations—

the expression " the Minister " means the Minister for Justice;

the expression " the Act " means the Irish Nationality and Citizenship Act, 1935 (No. 13 of 1935).

4. Every declaration of retention of citizenship of Saorstát Eireann made under sub-section (3) of Section 2 of the Act shall be in the Form No. 1 in the Schedule hereto or in a form to the like effect.

5. Every declaration of alienage made under sub-section (7) of Section 2 of the Act shall be in whichever of the Forms Nos. 2 and. 3 in the Schedule hereto is applicable in any particular case or in a form to the like effect.

6. Every declaration of alienage made under sub-section (3) of Section 7 of the Act shall be in the Form No. 4 in the Schedule hereto or in a form to the like effect.

7. Every declaration of alienage made under sub-section (2) of Section 9 of the Act shall be in the Form No. 5 in the Schedule hereto or in a form to the like effect.

8. Every declaration of alienage made under paragraph (c) of Section 11 of the Act shall be in the Form No. 6 in the Schedule hereto or in a form to the like effect.

9. Every declaration of alienage made under sub-section (2) of Section 21 of the Act shall be in the Form No. 7 to the Schedule hereto or in a form to the like effect.

10. Every declaration of acceptance of citizenship of Saorstát Eireann made under paragraph (d) of sub-section (3) of Section 4 of the Act shall be in whichever of the Forms in the Schedule hereto is applicable in any particular case, that is to say, either Form No. 8 or Form No. 9.

11. Every declaration of intention to continue to be ordinarily resident in Saorstát Eireann and to resume citizenship of Saorstát Eireann made under Section 14 of the Act shall be in the Form No. 10 in the Schedule hereto or in a form to the like effect.

12. Every declaration of election to retain Saorstát Éireann citizenship made under sub-sections (1) and (3) of Section 16 of the Act shall be in the Form No. 11 in the Schedule hereto or in a form to the like effect.

13.—(1) Every declaration made under paragraph (b) of Section 17 or under paragraph (c) of Section 18 of the Act electing to take citizenship of Saorstát Eireann as post-nuptial citizenship and proving to the satisfaction of the Minister that the person making such declaration has ceased or will, upon the acquisition of citizenship of Saorstát Eireann, cease to be a citizen of any other country, shall be in the Form No. 12 in Schedule hereto or in a form to the like effect.

(2) Every such declaration shall be accompanied by a certificate signed by some person qualified to certify that the person making the declaration will cease on the acquisition of citizenship of Saorstát Eireann to be a citizen of any other country.

14. Every declaration made under the Act and mentioned in these Regulations shall be lodged or registered (as the case may be) with the Minister by being sent by post to or by being left with the Secretary, Department of Justice, Dublin.

15. Every declaration (other than a declaration of retention of citizenship of Saorstát Eireann under sub-section (3) of Section 2 of the Act) made under the Act and mentioned in these Regulations shall:—

(a) if made in Saorstát Eireann, be made before a commissioner for oaths or a peace commissioner, and

(b) if made in the United Kingdom of Great Britain and Northern Ireland, be made before the High Commissioner of Saorstát Eireann or the Secretary of the Office of the said High Commissioner or a commissioner for oaths or ,a justice of the peace, and

(c) if made in any place other than Saorstát Eireann, or the United Kingdom of Great Britain and Northern Ireland, be made before any of the following persons that is to say:—

(i) a diplomatic or consular officer of Saorstát Eireann entitled by law to administer any oath and take any affidavit, or

(ii) a notary public, or

(iii) any person who is, by the law of the country in which the declaration is made, a commissioner for oaths or other person authorised to take affidavits and for that purpose to administer oaths.

16. Every declaration made under the Act and mentioned in these Regulations (other than a declaration made for the purposes of the issue of a certificate of naturalisation under Section 5 of the Act) shall, when being lodged or registered (as the case may be) with the Minister, be accompanied by a fee of ten shillings.

17. Every application for a certificate of naturalisation made under sub-section (1) of Section 3 of the Act shall be in writing in the Form No. 13 in the Schedule hereto or in a form to the like effect, and shall, when filled in and completed by the applicant for such certificate be sent by post to or left with the Secretary, Department of Justice, Dublin.

18. Every application for the issue pursuant to the powers conferred by Section 7 of the Act of a certificate of naturalisation to a person who has not attained the age of twenty-one years shall be in writing in the Form No. 14 in the Schedule hereto or in a form to the like effect and shall be lodged with the Minister by being sent by post to or by being left with the Secretary, Department of Justice, Dublin.

19.— (1) Every certificate of naturalisation issued under the Act shall be in such one of the Forms Nos. 15 to 18 in the Schedule hereto as is applicable in any particular case.

(2) The following fees shall be paid on or before the issue of the following certificates of naturalisation, that is to say:—

(a) (subject to the subsequent provisions of this paragraph) on every certificate of naturalisation issued under Section 4 of the Act on an application made under Section 3 of the Act, a fee of ten pounds, and

(b) on every certificate of naturalisation issued pursuant to the powers conferred by Section 6 of the Act, a fee of ten pounds, and

(c) on every certificate of naturalisation issued pursuant to the powers conferred by Section 7 of the Act, a fee of one pound, and

(d) on every certificate of naturalisation issued under Section 4 of the Act on the application of a woman who is the wife of a citizen of Saorstát Éireann or of a woman who is the wife of a person to whom a certificate of naturalisation is about to be issued under the Act, or of a woman who complies with the provisions of sub-section (5) of Section 4 of the Act, a fee of one pound.

20.—(1) Every application under sub-section (3) of Section 8 of the Act for a copy of a certificate of naturalisation shall be in the Form No. 19 in the Schedule hereto or in a form to the like effect.

(2) Every such application shall be sent by post to or be left with the Secretary, Department of Justice, Dublin, and shall be accompanied by a fee of ten shillings.

(3) Every copy of a certificate of naturalisation issued under sub-section (3) of Section 8 of the Act shall have endorsed thereon the following certificate:

21. Every application under Section 29 of the Act by a person who is a citizen (other than a naturalised citizen of Saorstát Eireann) for a certificate in writing stating that such person is, at the date of such certificate, a citizen of Saorstát Eireann, shall be accompanied by a fee of twelve shillings and sixpence.

*Here set out a full description of the documentary evidence produced and appended. In cases 1 and 3 a certificat de coutume should be submitted over the signature of an Officer of the Minister for Foreign Affairs (or a diplomatic or consular officer by him appointed) of the country according to whose law, past or present, the declarant's former nationality has been or will be lost. Full particulars of such signatory officer's official rank should be set out after such description. In case 2 the original document (or a copy thereof certified in the appropriate Ministry of Foreign Affairs, or by one of its duly authorised representatives in Saorstát Éireann or abroad) containing the declarant's formal declaration made according to the law of the declarant's former country of allegiance, to take up citizenship of Saorstát Éireann as his or her post-nuptial citizenship, should be produced and appended.
