SCHEDULE.

Scales of Fees.

The Minister for Local Government and Public Health, in exercise of the powers vested in him by Section 32 of the Housing (Ireland) Act, 1919, as amended by the Housing (Miscellaneous Provisions) Act, 1931 , by this his Order makes the following Rules for carrying the Housing of the Working Classes Acts, 1890 to 1931, into effect, that is to say:—

1 Citation.

1. These rules may be cited as the Housing (Architects for Schemes) Rules, 1935.

2 Interpretation.

2. The Interpretation Act, 1923 , shall apply for the purpose of the interpretation of these rules in the same manner in which it applies for the purpose of the interpretation of an Act of the Oireachtas.

3 Definitions.

3. In these rules the expression " the Act " means the Housing (Ireland) Act, 1919, as amended by the Housing (Miscellaneous Provisions) Act, 1931 ; and the expression " local authority " means and includes the local authority for the purposes of the Act of any urban district or town.

4 Qualifications.

4. No person shall act for remuneration as architect of a local authority in connection with a housing scheme made by such local authority under the Act unless he comes within one of the following classes, that is to say:—

(1) Corporate members of any of the following bodies, that is to say:—

(a) The Royal Institute of the Architects of Ireland;

(b) The Royal Institute of British Architects;

(c) The Institution of Civil Engineers of Ireland;

(2) Persons holding a degree in Architecture or Engineering from a recognised University;

(3) City, Borough or Town Surveyors who have satisfied the Minister that they are personally qualified to act as architect in connection with such housing schemes;

(4) Persons who have satisfied the Minister either by the production of written testimonials or by means of an examination that they are qualified to act as architect in connection with such housing schemes.

5 Fees.

5. —(1) Subject to the exceptions made by this rule the remuneration to be paid by a local authority to a person who acts as architect in connection with a housing scheme made by such local authority under the Act shall be in accordance with the scales of fees set forth in the Schedule to these rules.

(2) Where the Minister is satisfied that by reason of the special circumstances of a particular case any person who acts as architect in connection with a housing scheme made by a local authority under the Act should be paid fees which are not in accordance with the scales of fees set forth in the Schedule to these rules he may approve of the payment to such person of such fees.

(3) A local authority may, notwithstanding the provisions of the first paragraph of this Rule, pay to any person in accordance with an approval of the Minister given under the foregoing paragraph fees which are not in accordance with the scale of fees set forth in the Schedule to these rules.

(4) Nothing in this Rule shall affect the amount of any remuneration payable by a local authority to any person in pursuance of an agreement made before the date of this Order.

6 Travelling expenses.

6. Where a person acts as architect in connection with a housing scheme made by a local authority and the houses to be erected in pursuance of such housing scheme are situated at a distance of not less than thirty miles from the residence of such person, the local authority, with the consent of the Minister, may pay to such person in addition to the remuneration determined in accordance with the last preceding article a sum in respect of travelling expenses not exceeding the aggregate of the following amounts, that is to say:—

(1) An amount equal to sixpence for each mile travelled by such person for the purposes of his duties in relation to such housing scheme.

(2) An amount equal to one pound for each night which such person, by reason of his duties in relation to such housing scheme, has necessarily spent away from his residence.

SCHEDULE.

SCALES OF FEES.

Scale A.—Preparation of lay-out and development of plans.

For the preparation of plans, showing roads, building plots, house drains and sewerage, and buildings in block, including:—

(1) Conference with local authorities and their officials;

(2) Site Plan to ½500 scales;

(3) Surveying, levelling and preparation of contour plan;

(4) Lay-out plan or plans to a scale of 41½ ft. or 44 ft. to one inch;

and for preparing working drawings, sections, specifications, quantities and estimate for roads and sewers in accordance with the lay-out plans; advising on the same and on the preparation of contract; furnishing to the Contractor one copy of the drawings and specifications:

For each house shown on lay-out £1 per house.

Scale B—House plans, specifications and supervision of works, etc.

For taking instructions; preparing sketch designs; making approximate estimate of cost; preparing eighth scale drawings and specifications; obtaining tenders; advising on tenders and on preparation of contract; furnishing to the Contractor one copy of the drawings and specifications, and such other details as are necessary for the effectual carrying out of the works; general supervision; issuing certificates for payment and passing and certifying accounts;

Five Pounds for each house which is completed in accordance with the approved House Plans and Specification.

Fees payable where a scheme is abandoned or indefinitely postponed:—

1. Any fees payable in accordance with Scale A of this Schedule shall be paid in full.

2. Half shall be paid of the amount of any fees which, if the scheme had been completed, would have been payable under Scale B of this Schedule; and for the purposes of this paragraph the cost of building any house shall be taken to be the estimated cost as approved by the Minister.
