CEMENT (MANUFACTURE AND IMPORT) REGULATIONS, 1935.

CEMENT (MANUFACTURE AND IMPORT) REGULATIONS 1935, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE NINTH DAY OF MAY, 1935, PURSUANT TO SECTION 6 of THE CEMENT ACT, 1933 .

WHEREAS it is enacted by Section 6 of the Cement Act, 1933 that the Minister for Industry and Commerce may by order make regulations in relation to any matter or thing referred to in the said Act as prescribed :

NOW, THEREFORE, the Minister for Industry and Commerce in exercise of the power conferred on him by Section 6 of the Cement Act, 1933 , and of every and any other power him in this behalf enabling, makes by this Order the following regulations, that is to say :—

1. These regulations may be cited for all purposes as the Cement (Manufacture and Import) Regulations, 1935.

2. The Interpretation Act, 1923 , applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these regulations—

the expression " the Act " means the Cement Act, 1933 .

4. The form in which an application shall be made for a cement manufacture licence under section 10 of the act and the particulars to be stated in such application shall be the Form No. 1 in the Schedule to these regulations and the particulars required by such form. Every such application shall be made by sending such form duly filled up by post addressed to The Secretary, Department of Industry and Commerce, Government Buildings, Upper Merrion Street, Dublin.

5. The form of a cement manufacture licence granted under section 11 of the act shall be the Form No. 2 in the Schedule to these regulations.

6. The form in which an application shall be made for an import licence under section 33 of the act and the particulars to be stated in such application shall be the Form No. 3 in the Schedule to these regulations and the particulars required by such form.

7. The form of the Statement as to the price of the cement proposed to be imported under a licence, required by sub-section 3 of section 33 of the act, shall be the Form No. 4 in the Schedule to these regulations.

APPLICATION FOR A CEMENT MANUFACTURE LICENCE.

proposing to manufacture cement hereby apply to the Minister for Industry and Commerce for a cement manufacture licence.

(a) If the application is made by a body corporate, or a firm, or by a person or persons carrying on business under a trade name, the name of the body corporate, or the firm, or the trade name should be given here.

If the application is made on behalf of a body corporate it should be signed by the Secretary and sealed with the Seal of the body corporate duly authenticated or be otherwise duly authenticated in the manner provided by the constitution of the body corporate. If the application is made by a person or persons carrying on business under a trade name, the signature of such person or persons should be given.

CEMENT MANUFACTURE LICENCE.

The Minister for Industry and Commerce hereby authorises

to manufacture cement within the following area(s) :—

subject to the provisions of the Cement Act, 1933 , relating to standard of Portland cement (a) and to the conditions set out in the schedule hereto.

FORM No. 3.

APPLICATION FOR AN IMPORT LICENCE.

1. I (or we) (a)

proposing to import cement into Saorstát Eireann hereby apply to the Minister for Industry and Commerce for the grant to me (or us) of an import licence to import such cement.

2.— (i) The nature and quality of the cement proposed to be imported under such licence are :—

(ii) the quantity of such cement is ;

(iii) the country in which such cement was manufactured is ;

(iv) the country from which it is proposed to import such cement is ;

(v) the port in Saorstát Eireann through which it is proposed that such cement be imported is ;

(vi) the time within which it is proposed to import such cement is ;

(vii) the quantity and value (exclusive of Duty, if any) of cement imported by me (us) during the year ended 31st December last were ;

(viii) the stocks of cement held by me (us) at this date are ;

3. This application is accompanied by the Statement required by sub-section (3) of Section 33 of the Cement Act, 1933 .
