WORKMEN'S COMPENSATION (SCHEMES) REGULATIONS, 1934.

THE WORKMEN'S COMPENSATION (SCHEMES) REGULATIONS, 1934, MADE ON THE 9TH DAY OF NOVEMBER, 1934, BY THE REGISTRAR OF FRIENDLY SOCIETIES IN SAORSTÁT EIREANN PURSUANT TO SUBSECTION (10) OF SECTION 62 of THE WORKMEN'S COMPENSATION ACT, 1934 .

WHEREAS it is enacted by subsection (10) of section 62 of the Workmen's Compensation Act, 1934 , that the Registrar of Friendly Societies in Saorstát Eireann may make regulations for the purpose of carrying such section into effect :

NOW, THEREFORE, I, HENRY MacMANUS WHITTON, the Registrar of Friendly Societies in Saorstát Eireann, in exercise of the powers conferred on me by subsection (10) of section 62 of the Workmen's Compensation Act, 1934 , hereby make the following regulations, that is to say :—

1. Every application for a certificate in respect of a scheme pursuant to section 62 of the Workmen's Compensation Act, 1934 , shall be made in the Form A in the schedule to these regulations. If the scheme includes the workmen of more than one employer, a separate application shall be made by such employer.

2. Every application for a renewal of a certificate in respect of a scheme pursuant to section 62 of the Workmen's Compensation Act, 1934 , shall be made in the Form B in the schedule to these regulations. If the scheme in respect of which the renewal of the certificate is sought includes the workmen of more than one employer, a separate application shall be made by each employer.

3. The applicants for a certificate or a renewal of a certificate pursuant to section 62 of the Workmen's Compensation Act, 1934 , shall furnish to the Registrar of Friendly Societies in Saorstát Eireann all such information, actuarial or otherwise, supplemental to the information contained in the application, and such verification of any information furnished to him in respect of the application, as he may reasonably require for the purposes of making the certificate or the renewal thereof.

4. These regulations may be cited for all purposes as the Workmen's Compensation (Schemes) Regulations, 1934.

SCHEDULE.

WORKMEN'S COMPENSATION ACT, 1934 .

APPLICATION FOR CERTIFICATE OF THE REGISTRAR OF FRIENDLY SOCIETIES UNDER SECTION 62 OF THE ACT.

TO THE REGISTRAR OF FRIENDLY SOCIETIES :

Application is hereby made by the undersigned employer and workman (workmen) for your certificate under section 62 of the above Act in respect of the scheme of which two copies, each signed by all the persons who sign this application, are sent herewith.

Nature of employment :—

Situation of works :—

Full name and address of employer :—

The scheme includes (or does not include) other employers and their workmen.

A statement is sent herewith showing :—

(1) the views of the employer;

(2) the views of the workmen;

(3) the manner in which such views were ascertained.

A further statement is sent herewith showing :—

(1) that the scheme provides scales of compensation not less favourable to the workmen and their dependants than the corresponding scales contained in the above Act ;

(2) whether or not the scheme provides for contributions by the workmen and, if it does provide for such contributions, that the scheme confers benefits at least equivalent to those contributions, in addition to the benefits to which the workmen would have been entitled under the above Act;

(3) (i) total number of the workmen to whom the scheme is applicable; and

(ii) the manner in which it has been ascertained by ballot that a majority of the workmen to whom the scheme is applicable are in favour of such scheme;,

(4) that adequate provision is made to secure the discharge of liabilities arising under the scheme, both during the currency of the scheme and after the scheme is revoked or expired, so far as there may be any liabilities outstanding at the date of revocation or expiry.

The scheme does not contain any obligation upon the workmen to join the scheme as a condition of their hiring, and it does contain provisions enabling a workman to withdraw from the scheme.

WORKMEN'S COMPENSATION ACT, 1934 .

APPLICATION FOR RENEWAL OF A CERTIFICATE OF THE REGISTRAR OF FRIENDLY SOCIETIES, UNDER SECTION 62 OF THE ACT.

TO THE REGISTRAR OF FRIENDLY SOCIETIES :

Application is hereby made by the undersigned employer and workman (workmen) for a renewal of the certificate made by the Registrar of Friendly Societies pursuant to the application dated     day of      , 19 , made by(a)

Nature of employment :—

Situation of works :—

Full name and address of employer :—

Two copies of the scheme in respect of which the renewal of the certificate is sought, each signed by all the persons who sign this application, are sent herewith.

The scheme in respect of which the renewal of the certificate is sought is the same as the scheme in respect of which such certificate was made.

(Or,

A statement is sent herewith showing the modifications of the scheme in respect of which the renewal of the certificate is sought as compared with the scheme in respect of which such certificate was made).

A statement is sent herewith showing that adequate provision is made to secure the discharge of liabilities arising under the scheme in respect of which the renewal of the certificate is sought, both during the currency of such scheme and after such scheme is revoked or expired, so far as there may be any liabilities outstanding at the date of revocation or expiry.

The scheme in respect of which the renewal of the certificate is sought does not contain any obligation upon the workman to join it as a condition of his hiring, and it does contain provisions enabling a workman to withdraw from such scheme.
