STATUTORY RULES AND ORDERS. 1934. No. 351.

BEEF VOUCHER REGULATIONS, 1934.

WHEREAS it is enacted by sub-section (1) of section 46 of the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), that the Minister for Agriculture shall arrange for the issue to recipients of beef vouchers by means of which recipients will be enabled to obtain supplies of beef under Part IX of the said Act, and with that object the said Minister, after consultation with the Minister for Local Government and Public Health and the Minister for Industry and Commerce, may by order make regulations for all or any of the following purposes, that is to say :—

(a) providing for the distribution to recipients of beef vouchers entitling such recipients to obtain a weekly supply of beef under the said Part IX;

(b) prescribing (subject to the provisions of the said section 46) the form and contents of beef vouchers;

(c) prescribing (subject to the provisions of the said section 46) the weekly quantity of beef which each recipient shall be entitled so to obtain;

(d) securing that every person who is for the time being a recipient shall receive every week such beef voucher as he is entitled to in the circumstances of his case and that no beef voucher shall be issued to a person who is not a recipient;

(e) providing for such other matters as may be necessary or desirable for securing the due distribution of beef vouchers;

AND WHEREAS it is enacted by sub-section (2) of the said section 46 that regulations made under the said section if made with the concurrence of the Minister for Local Government and Public Health may impose on relieving officers and assistance officers the duty of distributing beef vouchers to recipients who are in receipt of outdoor relief or home assistance;

AND WHEREAS it is enacted by sub-section (4) of the said section 46 that regulations made under the said section shall provide for the weekly quantity of beef to be obtained by a recipient being fixed with due regard to the number and age ofhis dependants and, in the case of a recipient in receipt of unemployment assistance, the number of days on which he is unemployed in the relevant week in respect of which he is paid unemployment assistance:

NOW, I, Seamas O Riain, Minister for Agriculture, after consultation with the Minister for Local Government and Public Health and the Minister for Industry and Commerce and with the concurrence of the Minister for Local Government and Public Health, in exercise of the powers conferred on me by section 46 of the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934), and of every and any other power me in this behalf enabling, do hereby order and make the following Regulations, that is to say :—

1. These Regulations may be cited for all purposes as the Beef Voucher Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations the expression " the Act " means the Slaughter of Cattle and Sheep Act, 1934 (No. 42 of 1934).

4. Every beef voucher shall be in the form S.C.S. 8 set forth in the First Schedule to these Regulations and shall contain the particulars and details specified in or indicated by the said form.

5. (1) Every recipient who is a person in receipt of unemployment assistance and, in the relevant week in respect of which he is paid unemployment assistance, is unemployed and paid unemployment assistance for not less than four days shall be entitled to receive, from the unemployment assistance officer or other officer by whom and at the time and place at which he is so paid such unemployment assistance, a beef voucher entitling him to obtain the quantity of beef stated in the second column of the Second Schedule to these Regulations opposite the portion of the first column of the said Second Schedule which is applicable to him.

(2) Every recipient who is a person in receipt of unemployment assistance and, in the relevant week in respect of which he is paid unemployment assistance, is unemployed and paid unemployment assistance for not more than three days shall be entitled to receive from the unemployment assistance officer or other officer by whom and at the time and place at which he is so paid such unemployment assistance, a beef voucher entitling him to obtain the quantity of beef stated in the third column ofthe Second Schedule to these Regulations opposite the portion of the first column of the said Second Schedule which is applicable to him.

6. Every recipient being a person who is in receipt of outdoor relief or home assistance and not in receipt of unemployment assistance shall be entitled to receive from the relieving officer or assistance officer (as the case may be) for the area in which such recipient resides a beef voucher entitling such recipient to obtain the quantity of beef stated in the second column of the Second Schedule to these Regulations opposite the portion of the first column of the said Second Schedule which is applicable to such recipient.

7. (1) It shall be the duty of every relieving officer and every assistance officer to distribute, in accordance with the Act and these and any other relevant Regulations made thereunder, beef vouchers to recipients who are in receipt of outdoor relief or home assistance.

(2) A relieving officer or an assistance officer shall not distribute or give a beef voucher to any recipient who is in receipt of both unemployment assistance and outdoor relief or home assistance.

INSTRUCTIONS.

1. This Voucher may be presented during the above-mentioned week to any registered proprietor at his registered victualling premises; if a registered proprietor to whom this Voucher is presented is unable to supply the above-mentioned quantity of beef, this Voucher may then be presented to any other registered proprietor.

2. This Voucher must be signed in the space provided above by the person receiving the beef and such person must also insert in the said space his address and the date on which he receives the beef.

3. The registered proprietor supplying beef under this Voucher must enter his name and the address of his registered victualling premises in the space provided above.

SLAUGHTER OF CATTLE AND SHEEP ACT, 1934 .

Section 50.—" (1) Every person who sells, buys, barters, pawns, or takes in pawn, or offers to sell, buy, barter, pawn or take in pawn a beef voucher or any beef obtained in exchange for a beef voucher shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds or, at the discretion of the Court, to imprisonment for any term not exceeding one month.

" (2) Every alienation or purported alienation of a beef voucher, whether by way of sale, barter, or hypothecation, shall be void and of no effect.

" (3) Nothing in this section shall apply to the due presentation of a beef voucher for the purpose of obtaining a supply of beef under this Part of this Act or to the supplying or receiving of beef in exchange for a beef voucher under and in accordance with this Part of this Act."

Section 51.—" (1) No recipient shall be entitled to apply for or receive more than one beef voucher in respect of any one week, and in particular no recipient who is in receipt of both unemployment assistance and outdoor relief or home assistance shall be entitled to apply for or receive more than one beef voucher in respect of any one week.

" (2) Every recipient who applies for or who receives a beef voucher in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding two pounds, or, at the discretion of the Court, to imprisonment for any term not exceeding fourteen days."

Section 52.—" (1) It shall not be lawful for any person who is not for the time being a recipient to apply for or to receive a beef voucher.

" (2)Every person who applies for or receives or applies for and receives a beef voucher in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding two pounds or, at the discretion of the Court, to imprisonment for any term not exceeding fourteen days."
