STATUTORY RULES AND ORDERS. 1934. No. 321.

WHEAT BOUNTY (CEREAL YEAR 1934-35) REGULATIONS, 1934.

WHEREAS it is enacted by sub-section (1) of section 71 of the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), as amended by section 23 of the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), that if in any sale (wheat) season of a cereal year the ascertained average price per barrel of home-grown millable wheat for that season is less than the standard price per barrel for that season, every person who proves to the satisfaction of the Minister for Agriculture that in that season, he has sold to the holder of a milling licence, a registered wheat dealer, a registered distiller or the Minister for Industry and Commerce any home-grown millable wheat harvested during such cereal year or, being the holder of a milling licence has milled into flour or wheaten meal any home-grown wheat harvested during such cereal year and grown on premises in respect of which he was registered in the register of wheat growers during the period prescribed with the consent of the Minister for Finance in relation to such cereal year shall, subject to the provisions of the said first-mentioned Act (including the said section 71) be paid by the Minister for Agriculture out of moneys provided by the Oireachtas, in respect of every barrel of such wheat a sum (in the said first-mentioned Act referred to as a wheat bounty) equal to the difference between such ascertained average price per barrel and such standard price per barrel and it is enacted amongst other things by sub-section (2) of the said section 71, as so amended, that no wheat bounty shall be payable in respect of any home-grown millable wheat sold in a cereal year unless such wheat was grown on premises entered in the register of wheat growers during the period prescribed with the consent of the Minister for Finance in relation to such cereal year;

AND WHEREAS by virtue of section 64 of the Agricultural Produce (Cereals) Act, 1933 , the Minister for Agriculture is empowered to make by order regulations in relation to any matter or thing referred to in section 71 of the said Act as prescribed;

NOW, THEREFORE, I, Seamas O Riain, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Cereals) Acts, 1933 and 1934, and of every and any other power me in this behalf enabling, do hereby, with the consent of the Minister for Finance, testified by his signature hereto, order and make the following regulations, that is to say:—

1. These Regulations may be cited for all purposes as the Wheat Bounty (Cereal Year 1934-35) Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to an Act of the Oireachtas.

3. For the purposes of sub-sections (1) and (2) of section 71 of the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), as amended by section 23 of the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), the prescribed period in relation to the cereal year ending on the 31st day of July, 1935, shall be the period commencing on the 1st day of May, 1934, and ending on the 30th day of September, 1934.
