STATUTORY RULES AND ORDERS. 1934. No. 221.

WORKMEN'S COMPENSATION (SUBMISSION TO MEDICAL REFEREE) REGULATIONS, 1934.

WHEREAS by virtue of the Workmen's Compensation Act, 1934 (Commencement) Order, 1934 (Statutory Rules and Orders, No. 153 of 1934), the Workmen's Compensation Act, 1934 (No. 9 of 1934), came into operation on the 1st day of August, 1934,

AND WHEREAS it is enacted by sub-section (4) of Section 39 of the said Act that the Court may, subject to regulations made by the Minister for Justice with the concurrence of the Minister for Finance, submit to a medical referee for report any matter which seems material to any question arising in proceedings under this Act before the Court ;

NOW, THEREFORE, I, PATRICK J. RUTTLEDGE, Minister for Justice, in exercise of the powers conferred on me by sub-section (4) of Section 39 of the Workmen's Compensation Act, 1934 (No. 9 of 1934), and of every and any other power me in this behalf enabling, do hereby, with the concurrence of the Minister for Finance, testified by his signature hereto, make the following Regulations, that is to say :—

1. These Regulations may be cited for all purposes as the Workmen's Compensation (Submission to Medical Referee) Regulations, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. Before making a submission under sub-section (4) of Section 39 of the Workmen's Compensation Act, 1934 (No. 9 of 1934), the Court shall be satisfied, after hearing all medical evidence tendered by either side, that such evidence is either conflicting or insufficient on some matter which seems material to a question arising in the proceedings, and that it seems desirable to obtain a report from a medical referee on such matter.
