THE ROAD TRAFFIC (DRIVING LICENCE) (NON-RESIDENTS) REGULATIONS, 1934.

ROAD TRAFFIC ACT, 1933 .

The Minister for Local Government and Public Health, in exercise of the powers conferred on him by Section 42 of the Road Traffic Act, 1933 , and of all other powers conferred on him in that behalf, hereby makes the following regulations, that is to say :—

1. These regulations may be cited as the Road Traffic (Driving Licence) (Non-residents) Regulations, 1934.

2. The Interpretation Act, 1923 , shall apply for the purpose of the interpretation of these regulations in the same manner in which it applies for the purpose of the interpretation of an Act of the Oireachtas.

3. In these regulations—

the expression " The Act " means the Road Traffic Act, 1933 ;

the expression " Licensing body " means and includes any licensing authority, and also the following bodies, that is to say—

(a) The Royal Irish Automobile Club, Dawson Street, Dublin

(b) The Automobile Association, Suffolk Street, Dublin; and

the expression "The excise duty " means the excise duty for the time being required by law to be paid on the taking out of a driving licence otherwise than under these regulations.

4. A person who ordinarily resides outside Saorstát Eireann and who does not carry on business in Saorstát Eireann may apply to a licensing body for a grant to him by such licensing body of a driving licence.

5. A licensing body to whom an application is made under these regulations, if they are satisfied that every provision of the Act and of these regulations and of any other regulations made under the Act in relation to the grant of driving licences (other than the provision requiring the applicant to be ordinarily resident or carrying on business within the functional area of a licensing authority) have been complied with, and if the fees required by these regulations have been duly paid to the licensing body, shall grant a driving licence to the applicant.

6. The fee to be paid by the applicant in respect of the grant of a driving licence under these regulations shall be an amount equal to the excise duty.

7.—(1) Subject to the exceptions made by this Article, every provision of the Act and of any regulations made thereunder in relation to the form to be used for and the particulars and declaration to be furnished with an application for the grant of a driving licence otherwise than under these regulations and the form to be used for such a driving licence shall apply in relation to the form to be used for and the particulars and declarations to be furnished with an application for a grant of a driving licence under these regulations, and the form to be used for such a driving licence respectively.

(2) Every person who applies to a licensing body for the grant of a driving licence under these regulations shall furnish to such licensing body, in addition to the address where such person ordinarily resides or carries on business, the name and address of an agent in Saorstát Eireann through whom such person can be traced, and the form prescribed for such application shall be altered accordingly.

(3) Every driving licence granted under these regulations shall contain, in addition to the address of the licensee, the name and address of the agent in Saorstát Eireann through whom such licensee can be traced, and the form prescribed for a driving licence granted otherwise than under these regulations shall be altered accordingly

8. All fees received by a licensing authority in respect of the grant of driving licences under these regulations shall be disposed of in the same manner in which the excise duty is disposed of.

9. All fees received by a licensing body which is not a licensing authority shall be paid by such licensing body to the Minister at such times and in such manner as the Minister shall from time to time direct, and the amount of all fees so paid to the Minister shall be lodged by the Minister to the credit of the Road Fund.

10. In any regulation made by the Minister under Part III of the Act—

(1) Every reference to a licensing authority shall be interpreted as including every licensing body ;

(2) Every reference to a driving licence shall be interpreted as including driving licences granted under these regulations.
