STATUTORY RULES AND ORDERS. 1933. No. 188.

THE CATTLE (REGULATION OF EXPORT) ORDER, 1933.

WHEREAS it is enacted by subsection (1) of section 2 of the Agricultural Products (Regulation of Export) Act, 1933 (No. 26 of 1933), that if any country to which any agricultural product is usually exported from Saortát Eireann establishes any system of restriction or control of the import of that agricultural product into that country from Saorstát Eireann, the Minister for Agriculture may by order (in the said Act referred to as an export order) regulate and control the export of that agricultural product to that country from Saorstát Eireann in such manner as appears to him to be calculated to secure for exporters from Saorstát Eireann the maximum benefit permitted by the said system of restriction and control so established by such country, and in particular may, without prejudice to the generality of the foregoing provision, by such order provide (amongst other things) for the control and restriction of the export of such product to such country from Saorstát Eireann, and for making specified infringements of such order offences punishable on summary conviction and fixing the penalties for such offences:

AND WHEREAS the Government of the United Kingdom of Great Britain and Northern Ireland, being a country to which the following agricultural product, that is to say, cattle is usually exported from Saorstát Eireann, has established a system of restriction or control of the export of that agricultural product into that country from Saorstát Eireann:

NOW, THEREFORE, I SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Products (Regulations of Export) Act, 1933 (No. 26 of 1933), and of every and any other power me in this behalf enabling, do hereby order as follows:—

1 Short title and commencement.

1. (1) This Order may be cited for all purposes as the Cattle (Regulation of Export) Order, 1933.

(2) This Order shall come into operation on the 24th day of December, 1933.

2 Definitions.

2. In this Order—

the expression "the Minister" means the Minister for Agriculture; the word "cattle" means all animals of the bovine species except milch cows, springers, calves under six months old, and bulls for breeding purposes.

3 Application of the Interpretation Act, 1923 .

3. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4 Export permits.

4. (1) The Minister may issue, to such persons, at such times, and in such numbers as he shall think proper permits (in this Order referred to as export permits) authorising the export of cattle from Saorstát Eireann to Great Britain and Northern Ireland.

(2) Every export permit issued under this Order shall be in such form as the Minister shall think proper, and shall be expressed and shall operate to authorise the export from Saorstát Eireann to Great Britain or Northern Ireland of a specified number of cattle within a specified period.

5 Procedure on export of cattle.

5. Whenever any cattle are exported under an export permit or permits from Saorstát Eireann to Great Britain or Northern Ireland, the exporter of such cattle shall produce and deliver to the proper officer of customs and excise the said export permit or permits duly completed by him, and thereupon the said officer shall deal with the said export permit or permits in such manner as the Minister shall direct.

6 Restriction of export of cattle to Great Britain or Northern Ireland.

6. (1) It shall not be lawful for any person to export all cattle from Saorstát Eireann to Great Britain or Northern Ireland save under and in accordance with an export permit issued under this Order and after due compliance with such of the provisions of this Order as are required to be complied with by such exporter.

(2) Every person who exports or attempts to export any cattle from Saorstát Eireann to Great Britain or Northern Ireland in contravention of this Article shall be guilty of an offence under this Article and shall be liable on summary conviction thereof to a fine not exceeding five pounds for every head of cattle so exported or attempted to be exported.
