THE ELECTORAL ACT (ALTERATION OF REGISTRATION RULES) ORDER, 1933.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

LECTORAL ACT, 1923.

WHEREAS by sub-section (2) of Section 11 of the Electoral Act, 1923 (in this Order referred to as "the Act"), it is provided amongst other things that the Minister for Local Government may by Order alter the rules contained in the First Schedule to the Act for the purpose of carrying the Act into full effect:

AND WHEREAS by Rule 7 of the said First Schedule to the Act it is provided that certain duties in relation to the preparation of the register are to be performed by a person holding the office of collector of poor rate:

AND WHEREAS the powers of the Minister for Local Government under the Act are now vested in the Minister for Local Government and Public Health (in this Order referred to as "the Minister"):

AND WHEREAS it is necessary for the purpose of carrying the Act into effect that provision be made for the performance of the said duties during a period when the said office is vacant:

NOW THEREFORE the Minister, in exercise of the powers conferred on him by the said sub-section (2) of Section 11 of the Act, and in exercise of every other power enabling him in this behalf, hereby orders as follows, that is to say:—

1. This Order may be referred to as "the Electoral Act (Alteration of Registration Rules) Order, 1933."

2. The Interpretation Act, 1923 , shall apply to the interpretation of this Order in the same manner in which it applies to the interpretation of an Act of the Oireachtas.

3. Rule 7 of the First Schedule to the Act shall be and is hereby altered by the insertion at the end of the said rule of the following paragraph, that is to say:

(g) If during the period between the 15th day of November in any year and the 1st day of June in the subsequent year the duties imposed by this rule on the person holding the office of collector of poor rate, or any portion of the said duties, have not been performed in any collection district in which, for the time being the office of collector of poor rate is vacant, and the registration officer is of opinion that, in order that the register then in course of preparation should be duly and properly prepared the performance of the said duties should be commenced or recommenced in such collection district at once and without waiting for the said vacancy to be filled, the following provisions shall apply, that is to say:

(i) The registration officer with the consent of the Minister may appoint a person to perform the said duties in the said collection district.

(ii) If by reason of delay in the performance of the said duties caused by the said vacancy it is, in the opinion of the registration officer, impossible for one person satisfactorily to perform the said duties in the whole of such collection district within such time as is available having regard to the provisions of the Act in regard to the publication of the electors lists, the registration officer, with the consent of the Minister, may appoint so many persons as he thinks necessary to perform the said duties in the said collection district, and may specify for each such person the portion of such collection district in which such person is to perform the said duties.

(iii) Where a person is appointed under this paragraph to perform in a collection district, or in portion of a collection district, the duties imposed by this rule on the person holding the office of collector of poor rate, this rule shall have effect during the period from the date of such appointment until the completion of the register which was in course of preparation on such date, in and in relation to such collection district or portion of a collection district (as the case may be) as if such person were the person holding the office of collector of poor rate in such collection district whether another person is or is not appointed during such period to such office.
