THE KILRUSH PIER, COUNTY CLARE ORDER, 1933.

The Kilrush Pier, County Clare Order, 1933, made by the Minister for Industry and Commerce under the Shannon Act, 1885, the Public Works Loans Act, 1906, and the Ministry of Transport Act, 1919, and the Ministry of Transport (Commissioners of Public Works in Ireland Transfer and Exception of Powers) Order, 1919

WHEREAS by Section 6 of and the First Schedule to the Shannon Act, 1885, the Pier Authority for the Kilrush Pier in the County of Clare (hereinafter referred to as " The Pier Authority ") is authorised to levy tolls in respect of the said Pier in accordance with the provisions of the said section and the Second Schedule to the said Act :

AND WHEREAS by Section 4 of the Public Works Loans Act, 1906, the Commissioners of Public Works in Ireland may, notwithstanding anything contained in Section 6 of the Shannon Act, 1885, at any time after giving due notice by advertisement in a newspaper circulating in the district and hearing any objection which may be made by local authorities or traders interested make an Order sanctioning the levying of such tolls in respect of the several matters mentioned in the Second Schedule to the Shannon Act, 1885, as the Minister for Finance may approve :

AND WHEREAS by the Ministry of Transport Act, 1919, and the Ministry of Transport (Commissioners of Public Works in Ireland Transfer and Exception of Powers) Order, 1919, the powers and duties of the Commissioners of Public Works in regard to piers have been transferred to the Minister for Industry and Commerce :

AND WHEREAS the Pier Authority has applied to the Minister for Industry and Commerce for authority to charge tolls in respect of the said Pier in the manner and to the extent specified in the Schedule to this Order :

AND WHEREAS the conditions contained in Section 4 of the Public Works Loans Act, 1906, have been duly complied with and the Minister for Finance has approved the levying of the tolls specified in the said Schedule to this Order :

NOW, THEREFORE, the Minister for Industry and Commerce in pursuance of the powers vested in him and of every other power him in this behalf enabling hereby sanctions the levying by the Pier Authority in respect of the said Pier of the Quayage and Wharfage Rates specified in the Schedule to this Order.

The Kilrush Pier, County Clare Order, 1921, is hereby revoked : Provided, however, that any rates due to the Pier Authority under the said Order shall be payable to the Pier Authority as if the said Order had not been revoked.

This Order may be cited as " The Kilrush Pier, County Clare Order, 1933."

Goods, etc., not removed from the Pier within 48 hours will be chargeable with half the above rates for each day or part of a day until removed. No less a sum than 2d. wharfage to be received in any case.

III. EXEMPTIONS.

Fishing Boats and Small Boats when not engaged in carrying Goods or Passengers. Passengers' Luggage and Military Stores. Fuel for Steamers, if carried direct on board without being laid on the Quay.
