THERAPEUTIC SUBSTANCES (ADVISORY COMMITTEE) RULES, 1933.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

THE THERAPEUTIC SUBSTANCES ACT, 1932 .

The Minister for Local Government and Public Health in exercise of the powers vested in him by sub-section (4) of section 2 of the Therapeutic Substances Act, 1932 , does hereby make the following rules, that is to say:—

1 GENERAL.

1.—(1) These rules may be cited as the Therapeutic Substances (Advisory Committee) Rules, 1933.

(2) In these rules:—

(i) the expression "Advisory Committee" means the Therapeutic Substances Advisory Committee;

(ii) the expression "the Act" means the Therapeutic Substances Act, 1932 ;

(iii) the expression "appointing authority" means an authority authorised by the Act to appoint a member of the Advisory Committee; and the expression "appointing authorities" shall be construed accordingly.

2. The Interpretation Act, 1923 , applies to the interpretation of these rules in like manner as it applies to the interpretation of an Act of the Oireachtas.

3 TIMES OF APPOINTMENT.

3.—(1) The first appointment of members of the Advisory Committee shall be made by the appointing authorities during the period commencing on the 1st day of May, 1933, and ending on the 31st day of July, 1933, and every such appointment shall be deemed to take effect as from the 1st day of August, 1933.

(2) In every third year after the year in which the first appointment of members of the Advisory Committee is made, an appointment of members of the Advisory Committee shall be made by the appointing authorities during the period of three months ending on the 31st day of July, and every such appointment shall be deemed to take effect as from the 1st day of August next following such day.

4 CASUAL VACANCIES.

4.—(1) A casual vacancy occurring in the membership of the Advisory Committee by reason of the death or resignation of a member thereof shall be filled by the appointing authority by whom such member was appointed within one month after the occurrence of such vacancy, or such further time as the Minister for Local Government and Public Health may allow.

(2) A person appointed to fill a casual vacancy in the membership of the Advisory Committee shall, unless he sooner dies or resigns, hold office as a member of the Advisory Committee for the residue of the period for which the member whose death or resignation occasioned the vacancy would have held office as such member, if he had not died or resigned.

5 QUORUM.

5. The quorum of every meeting of the Advisory Committee shall be three.

6 PROCEDURE.

6. The Advisory Committee shall appoint one of their members to be chairman of the Committee, and may appoint another of their members to be vice-chairman of the Committee, who shall respectively hold office for such period as the Committee shall determine.

7. At every meeting of the Advisory Committee the chairman of the Committee, if present, shall be chairman, but if the chairman of the Committee be absent, then the vice-chairman of the Committee shall be chairman, and if both the chairman and vice-chairman of the Committee be absent, then such member of the Committee as the members then present shall choose, shall be chairman.

8. The Advisory Committee may act notwithstanding any vacancy in their number.

9. Subject to the provisions of these rules, the proceedings of the Advisory Committee shall be regulated in such manner as the Committee thinks fit.
