STATUTORY RULES AND ORDERS. 1931. No. 61.

THE LOCAL OFFICES AND EMPLOYMENTS (GAELTACHT) ORDER, 1931.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS by the Local Offices and Employments (Gaeltacht) Order, 1928 (hereinafter referred to as "the Principal Order"), the Minister for Local Government and Public Health did make and prescribe rules and regulations with respect to the continuance of persons in certain offices and employments under local authorities:

AND WHEREAS it is now expedient to amend the Principal Order:

NOW, THEREFORE, the Minister for Local Government and Public Health, in exercise of the powers recited in the Principal Order, hereby orders as follows, that is to say:—

ARTICLE I.

(1) This Order may be cited as "the Local Offices and Employments (Gaeltacht) Order, 1931."

(2) This Order and the Principal Order shall be read as one Order, and may be collectively cited as "the Local Offices and Employments (Gaeltacht) Orders, 1928 and 1931."

ARTICLE 2.

(1) Article 3 of the Principal Order shall, in relation to the continuance in an office or employment of a person who is or has been appointed to such office or employment on or after the 1st day of February and before the 1st day of July in any year, have effect with the substitution therein for the words "after the expiration of three years from the date of such appointment" of the words "after the 3lst day of July next following the expiration of three years from the date of such appointment."

(2) Article 3 of the Principal Order shall, in relation to the continuance in an office or employment of a person who is or has been appointed to such office or employment on or after the 1st day of July in any year, and before the 1st day of February in the succeeding year, have effect with the substitution therein for the words "after the expiration of three years from the date of such appointment" of the words "after the last day of February next following the expiration of three years from the date of such appointment."

ARTICLE 3.

(1) Subject to the provisions of the next sub-article of this Article, the following offices and employments, that is to say—

(a) any office or employment the duties of which are in the opinion of the Minister of a minor nature, and

(b) any office or employment for which the total annual remuneration does not exceed £40,

shall be excluded from the First Schedule to the Principal Order, and the Principal Order shall have effect accordingly.

(2) Nothing in this Article shall have effect so as to exclude from the First Schedule to the Principal Order, or otherwise from the operation of the Principal Order the office or employment of any home assistance officer, sanitary sub-officer, nurse or midwife.

ARTICLE 4.

Where a person whose continuance in an office or employment under a local authority is regulated by Article 3 of the Principal Order, is, during such continuance, appointed by the local authority to another office or employment, the provisions of Article 3 of the Principal Order as amended by Article 2 of this Order shall apply to the continuance of such person in such last-mentioned office or employment as if such person was not, immediately before such appointment, in the service of the local authority.
