THE LONDENDERRY AND LOUGH SWILLY (LETTERKENNY TO BURTONPORT EXTENSION) RAILWAY ORDER, 1898, AMENDMENT ORDER, 1931.

THE LONDONDERRY AND LOUGH SWILLY (LETTERKENNY TO BURTONPORT EXTENSION) RAILWAY ORDER, 1898, AMENDMENT ORDER, 1931, MADE ON THE FOURTEENTH DAY OF APRIL, 1931, BY THE MINISTER FOR INDUSTRY AND COMMERCE UNDER SECTION 2 OF THE RAILWAYS (IRELAND) ACT, 1896.

WHEREAS it is enacted by section 2 of the Railways (Ireland) Act, 1896, that where such agreement as is authorised by sub-section (1) of section 4 of the Light Railways (Ireland) Act, 1889, has been made by the Treasury with a railway company section 5 of the Light Railways (Ireland) Act, 1889, relating to the Order in Council to confirm the agreement, shall apply with certain modifications thereof including the following modification, that is to say—

(d) The Order may upon the application of the Treasury be altered or added to by an amending Order made in like manner and subject to the like provision as the original Order :

AND WHEREAS the Londonderry and Lough Swilly (Letterkenny to Burtonport Extension) Railway Order, 1898 (hereinafter in this Order called the original Order), made pursuant to the Tramways (Ireland) Acts, 1860 to 1896, has confirmed the agreement set out in the Schedule D thereto, being an agreement made on the 6th day of January, 1898, between the Treasury of the first part, the Commissioners of Public Works of the second part, and the Londonderry and Lough Swilly Railway Company (hereinafter in this Order called the Company) of the third part :

AND WHEREAS the Minister for Finance has agreed with the Company that the agreement confirmed as aforesaid by the original Order shall be modified as follows, that is to say, by the substitution of the words " so many trains as the Minister for Industry and Commerce shall for time to time determine having regard to the services which the company run or propose to run under the powers conferred by the Railways (Road Motor Services) Act, 1927 " for the words " daily as many trains as will fully meet the requirements of the passenger and goods traffic from time to time, with a minimum of two trains each week-day each way and one each way on Sundays " now contained in Clause 13 thereof, and has made application to the Minister for Industry and Commerce that the original Order be altered or added to by an amending Order for the purpose of giving effect to the said modification of the agreement :

NOW, THEREFORE, I, PATRICK McGILLIGAN, the Minister for Industry and Commerce, in exercise of the powers conferred on me by paragraph (d) of section 2 of the Railways (Ireland) Act, 1896, and every power me in this behalf enabling, do hereby order as follows :

1. The modification agreed upon between the Minister for Finance and the Company of the agreement made on the 6th day of January, 1898, and set out in the Schedule D to the original Order, that is to say, the substitution in Clause 13 of the said agreement of the words " so many trains as the Minister for Industry and Commerce shall from time to time determine having regard to the services which the company run or propose to run under the powers conferred by the Railways (Road Motor Services) Act, 1927 " for the words " daily as many trains as will fully meet the requirements of the passenger and goods traffic from time to time, with a minimum of two trains each week-day each way and one each way on Sundays " is hereby confirmed and the original Order shall be construed and have effect accordingly.

2. This Order may be cited for all purposes as the Londonderry and Lough Swilly (Letterkenny to Burtonport Extension) Railway Order, 1898, Amendment Order, 1931.
