ORDER OF THE DEPARTMENT OF AGRICULTURE AND TECHNICAL INSTRUCTION FOR IRELAND.

IMPORTATION OF RAW APPLES ORDER, 1930.

The Department of Agriculture and Technical Instruction for Ireland, by virtue and in exercise of the powers conferred on them by the Destructive Insects and Pests Acts, 1877 to 1929, and of every other power them in this behalf enabling do hereby, with the concurrence of the Minister for Agriculture, Order as follows :—

RESTRICTION ON IMPORTATION OF RAW APPLES GROWN IN THE UNITED STATES OF AMERICA.

1. For the prevention of the introduction of the Apple Fruit Fly, the importation into Saorstát Éireann between the date of this Order and the 15th day of November, 1930, and between the 7th day of July and the 15th day of November in the year 1931 and in every subsequent year, of any raw apples grown in the United States of America is hereby prohibited unless each consignment is accompanied by a certificate signed by a duly authorised Inspector of the Federal Department of Agriculture in the Form set out in the Schedule hereto.

The certificate prescribed by this Article shall be delivered to an officer of Customs and Excise at the same time as and together with the entry relating to the consignment.

DISPOSAL OF RAW APPLES IMPORTED IN CONTRAVENTION OF THIS ORDER.

2. Raw apples grown in the United States of America and imported into Saorstát Éirreann between the date of this Order and the 15th day of November, 1930, and between the 7th day of July and the 15th day of November in the year 1931 and in every subsequent year, without such a certificate as is prescribed by the foregoing article shall be forthwith destroyed by and at the expense of the importer unless they are re-exported or are disposed of in accordance with the terms of a licence issued by an Inspector.

POWERS OF INSPECTION AND ENTRY.

3. An Inspector may, upon production, if so required, of his appointment or authority, open and examine and take samples of the contents of any consignment or package containing or suspected to contain raw apples which have been grown in or are suspected to have been grown in the United States of America, and enter any premises upon which any such raw apples are or are suspected to be.

OFFENCES.

4. Any person failing to comply with the provisions of Article 2 of this Order, or with the terms of any licence granted thereunder, or wilfully obstructing or impeding an Inspector in exercise of his powers under this Order shall be liable, in the case of a first offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds.

DEFINITIONS.

5. In this Order " Inspector " means an Inspector of the Department of Agriculture and Technical Instruction for Ireland.

SHORT TITLE.

6. This Order may be cited as the Importation of Raw Apples Order, 1930.
