26/06/1929: Garda Siochana, (Promotion) Regulations, 1929.


WHEREAS it is enacted by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925) that the Minister for Justice may from time to time, subject to the approval of the Executive Council, make regulations in relation (inter alia) to the promotion of members of the Gárda Síochána:

AND WHEREAS regulations entitled the Gárda Síochána (Promotion) Regulations, 1925, were duly made under the said section by the Minister for Justice with the approval of the Executive Council:

AND WHEREAS it is expedient to amend the said regulations in the manner hereinafter appearing:

NOW I, James Fitzgerald-Kenney, Minister for Justice, with the approval of the Executive Council, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 , and of every and any other power me in this behalf enabling, do hereby make the following regulations:—

1. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

2. In these Regulations the expression "the Principal Regulations" means the Gárda Síochána (Promotion) Regulations, 1925.

3. Paragraph 1 of the Principal Regulations is hereby revoked and the following paragraph is hereby inserted in the Principal Regulations in lieu thereof, namely:

"1. Subject as hereinafter provided, a Guard shall not be eligible for promotion to the rank of Sergeant unless he has passed, or unless he is exempted, under these regulations from passing an examination in educational subjects and an examination in police duties, which examinations are hereinafter referred to as the Class III. Promotion examinations:

Provided, however, that a proportion of vacancies in the rank of Sergeant, not exceeding twenty-five per cent. may be filled by the promotion of Guards who have shown special zeal and ability in the performance of their duties notwithstanding that they may not have passed the Class III. Promotion examinations."

4. These Regulations may be cited for all purposes as the Gárda Síochána (Promotion) Regulations, 1929, and shall be construed as one with the Principal Regulations, and these Regulations and the Principal Regulations may be cited together as the Gárda Síochána (Promotion) Regulations, 1925 and 1929.
