15/03/1929: Gárda Síochána Allowances Order, 1929.


WHEREAS it is enacted by sub-section (1) of Section 12 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925) that the Minister for Justice may with the sanction of the Minister for Finance from time to time by order regulate and appoint the rates of pay and allowances (including conditions applicable thereto) to be paid to the several ranks and to the several grades of each rank of the officers and men of the Gárda Síochána, and it is enacted by sub-section (2) of the said section 12 that before making an order under the said section the Minister for Justice shall cause the draft of the Order to be submitted to the several representative bodies representing the several ranks and grades of the Gárda Síochána who would be affected by the order when made, and shall consider any representations made to him in respect of the draft order by any such representative body:

AND WHEREAS an order entitled the Gárda Síochána Allowances Order, 1926, was duly made by the Minister for Justice regulating and appointing the allowances (including conditions applicable thereto) to be paid to the members of the Gárda Síochána:

AND WHEREAS it is expedient to amend the said Order in the manner hereinafter appearing:

AND WHEREAS before making this order the Minister for Justice duly caused the draft thereof to be submitted to the several representative bodies representing the several ranks and grades of the Gárda Síochána who would be affected by the Order when made and has considered the representations made to him in respect of said draft Order by such representative bodies:

NOW, I, JAMES FITZGERALD-KENNEY, Minister for Justice, with the sanction of the Minister for Finance as testified by his signature hereto, in exercise of the powers conferred on me by section 12 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and of every and any other power me in this behalf enabling do hereby order as follows:

Application of Interpretation Act.

1. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

Definition of Principal Order.

2. In this Order the expression " The Principal Order " means the Gárda Síochána Allowances Order, 1926.

Subsistence Allowance.

3.—(1) The following rates of subsistence allowance shall ordinarily be payable in lieu of the ordinary rates specified in paragraph (a' of Article of the Principal Order:—

I.—OFFICERS.

Provided that after a stay of 14 nights in one place or for the whole period if the member concerned knew beforehand that his stay would exceed 14 nights, the nightly rates shall be as follows, viz.:—

and provided also that for periods in excess of 30 nights in one place special rates shall be fixed according to the circumstances of each case.

(2) The special subsistence allowance which under paragraph (d) of Article 2 of the Principal Order may be granted in lieu of pay to members of the Force who have been suspended from duty shall in the case of Officers be at the rate of 8s, per day.

Locomotion Expenses.

4. The word " Mileage " in line 9 of paragraph (a) of Article 3 of the Principal Order shall be deleted, and the word " locomotion " shall be substituted therefor.

Cycling Allowance.

5. An allowance at the rate of £2 10s. per annum shall be substituted for the allowance at the rate of £5 per annum mentioned in paragraph (a) of Article 4 of the Principal Order.

Uniform Allowance.

6. An allowance of £40 shall be substituted for the allowance of £50 mentioned in paragraph (a) of Article 6 of the Principal Order.

Boot Allowance.

7. The Boot Allowance mentioned in Article 7 of the Principal Order shall cease to be payable.

Transport Allowance.

8. An allowance at the rate of 25s. per month shall be substituted for the allowance at the rate of 30s. per month mentioned in Article 10 of the Principal Order.

Short Title, Construction and Commencement of Order.

9.—(1) This Order may be cited for all purposes as the Gárda Síochána Allowances Order, 1929, and shall be construed as one with the Principal Order, and the Principal Order and this Order may be cited together as the Gárda Síochána Allowances Orders, 1926 and 1929.

(2) This Order shall come into operation on the 1st day of April, 1929.
