REGULATIONS ENTITLED PLACES OF DETENTION (STATE CONTRIBUTIONS) REGULATIONS, 1928.

WHEREAS it is enacted by sub-section (2) of section 110 of the Children Act, 1908, that there shall be paid, out of money provided by Parliament, towards the cost of maintaining in a place of detention under sub-section (1) of the said section any child or young person committed to custody on remand or commitment for trial or in lieu of imprisonment or in default of payment of a fine, damages, or costs, such contributions as may be fixed by regulations made by the Chief Secretary with the approval of the Treasury :

AND WHEREAS by virtue of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and orders made thereunder the reference in the said sub-section (2) of the said section 110 to moneys provided by Parliament is to be construed as a reference to moneys provided by the Oireachtas, and the powers conferred by the said sub-section on the Chief Secretary are now exercisable by the Minister for Education with the approval of the Minister for Finance :

NOW I, JOHN MARCUS O'SULLIVAN, Minister for Education, in exercise of the powers conferred on me by sub-section (2) of section 110 of the Children Act, 1908, as adapted by or under the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power me in this behalf enabling and with the approval of the Minister for Finance do hereby make the following regulations, that is to say :—

1. The contribution from moneys provided by the Oireachtas towards the cost of maintaining a child or young person committed to custody in a place of detention on remand or commitment for trial or in lieu of imprisonment or in default of payment of a fine, damages or costs shall as on and from the 1st day of April, 1927, be at the rate of two shillings and sixpence a day.

2. Every such contribution as is mentioned in the foregoing paragraph at the said rate of two shillings and sixpence a day shall be inclusive of any capitation grant for the provision in such place of detention of clothing for the child or young person in respect of whom such contribution is made.

3. Re-imbursement under sub-section (2) of section 110 of the Children Act, 1908, to the authorities of the Garda Siochana from moneys provided by the Oireachtas shall be claimed quarterly, in the months of January, April, July, and October, from the Inspector of Reformatory and Industrial Schools, and the claims shall be in the form set out in the Schedule hereto.

4. The regulations made under sub-section (2) of section 110 of the Children Act, 1908, on the 31st day of December, 1909, by the Chief Secretary are hereby revoked as from the 1st day of April, 1927.

5. These regulations may be cited as the Places of Detention (State Contributions) Regulations, 1928.
