THE STATISTICS (ROAD MOTOR PASSENGER SERVICES: PARTICULARS AS TO STAFF) (ORDER, 1928, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE UNDER SUB-SECTION (1) OF SECTION 16 of THE STATISTICS ACT, 1926 .)

WHEREAS it is provided by sub-section (1) of section 16 of the Statistics Act, 1928, that the Minister for Industry and Commerce may by Order do all or any of the following things, that is to say:—

(a) Prescribe the subject-matter, nature, character, and periodicity of the statistics to be collected under this Act, and the time at or the occasion on which the same are to be collected;

(b) Prescribe, subject to the provisions of this section, the person or classes of persons by whom returns are to be made or information is to be given for the purpose of any statistics collected under this Act;

(c) make regulations for the collection, compilation, abstraction, or publication of statistics generally or any particular class or classes of statistics under this Act;

(d) Prescribe the schedules, forms, instructions and other documents to be used in the collection, compilation, abstraction or publication of statistics generally or of any particular class or classes of statistics under this Act;

(e) Prescribe any matter or thing which is referred to in this Act as prescribed or to be prescribed by regulations made under this Act.

NOW, I, Patrick McGilligan, the Minister for Industry and Commerce, in pursuance of the powers conferred on me by sub-section (1) of section 16 of the Statistics Act, 1926 , and all other powers enabling me in that behalf do hereby order:

1. Statistics shall be collected for the last pay-week in each of the months of February and August of each year in respect of the numbers of persons, and the amounts paid in salaries and wages to such persons, employed in connection with road motor services, other than tramways and light-railways, for the conveyance on public roads of fare-paying passengers by means of one or more mechanically-propelled vehicles having each a s???ating capacity of more than six seats (excluding the driver's seat).

2. The Statistics to be collected are the information, returns and particulars set out in the Schedule to this Order.

3. The following are the persons by whom returns are to be made, or information is to be given for the purpose of the said Statistics, that is to say, every person who runs a road motor service referred to in Clause I of this Order.

4. The said Statistics shall be collected by means of and in the manner provided by the form and instructions set out in the Schedule to this Order.

5. The forms and instructions shall be transmitted by the Director of Statistics to all persons by whom returns are to be made or information given, and the forms shall be returned to the Director of Statistics duly filled up and completed by such persons not later than seven days after the period to which the return relates.

6. The Interpretation Act, 1923 , applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

7. This Order may be cited for all purposes as the Statistics (Road Motor Passenger Services: Particulars as to Staff) Order, 1928.

† The said Clause 1 reads as follows:

1. Statistics shall be collected for the last pay-week in each of the months of February and August of each year in respect of the numbers of persons, and the amounts paid in salaries an wages to such persons employed in connection with road motor services, other than tramways and light-railways, for the conveyance on public roads of fare-paying passengers by means of one or more mechanically-propelled vehicles having each a seating capacity of more than six seats (excluding the driver's seat).

SCHEDULE I.—PART II.

Instructions for the compilation of the Returns specified in Schedule I.—Part I.

(1) The return should be made in respect of each of the pay-bill weeks ending the last Saturday or nearest payday of February and the last Saturday or nearest payday of August of each year, and should be forwarded to the Director of Statistics, Department of Industry and Commerce, Lower Castle Yard (South), Dublin, not later than seven days after the period to which the return relates.

(2) In estimating the particulars in respec of persons employed partly in the Road Motor Services referred to in Clause I of the Order to which this Schedule is annexed and partly in other business connected with the proprietor the following method should be adopted, viz., 3 employees engaged each for one-third of the week in the Road Motor Services referred to in the said Clause I should be counted for the purposes of the return as 1 employee engaged fully for one week.

(3) Separate returns for male and female staff should be made, and on each return "Adults" should be distinguished from "Juniors." "Juniors" mean Staff not paid at Adult rates.

(4) Particulars should be included of all staff, whether permanent or casual, paid salaries or wages for three or more days in the particular week. Staff paid for less than three days in the particular week should be excluded.

(5) The " weekly salary or wages " payable should be the total amount which would have been paid if the employees worked the normal time required by the terms of their engagement. Salary should be calculated on the basis of 1/52 of the annual salary.

(6) The " amount earned " should be the total amount actually paid to the employees during the particular week. This amount should include any extra payments made, e.g., for overtime worked, Sunday duty, etc., but should exclude any deductions for absences, etc. No deduction, however, should be made for Unemployment or National Health Insurance.
