HEAVY MOTOR CAR (AMENDMENT) ORDER, 1928.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

To the Council of each Administrative County; to the Council of each County Borough; to the Urban District Council of each Urban County District; and to all others whom it may concern.

WHEREAS by section 12 of the Motor Car Act, 1903, as adapted by the Adaptation of Enactments Act, 1922 , and the Ministers and Secretaries Act, 1924 , it is enacted in effect as follows:

(1) The Minister for Local Government and Public Health by regulations made under section 6 of the Locomotives on Highways Act, 1896, may, as respects any class of vehicle mentioned in the regulations, increase the maximum weights of three tons and four tons mentioned in section 1 of that Act, subject to any conditions as to the use and construction of the vehicle which may be made by the regulations.

(2) The power of the Minister for Local Government and Public Health to make regulations under section 6 of the Locomotives on Highways Act, 1896, shall, as respects motor cars exceeding two tons in weight unladen, include a power to make regulations as to speed.

AND WHEREAS by certain orders made in pursuance of the said enactment entitled the Heavy Motor Car (Ireland) Order, 1905, as amended by the Road Vehicles (Registration and Licensing) Regulations, 1921; the Heavy Motor Car (Ireland) (Amendment) Order, 1911; the Heavy Motor Car (Ireland) (Amendment) Order, 1919; the Heavy Motor Car (Amendment) Order, 1921; the Heavy Motor Car (Amendment) Order, 1924, and the Heavy Motor Car (Amendment) Order, 1925, regulations were made with respect to the motor cars therein defined as heavy motor cars:

AND WHEREAS it is expedient that certain of the regulations made by the said recited Orders should be modified and amended in manner hereinafter appearing:

NOW THEREFORE I, the Minister for Local Government and Public Health, in exercise of the powers vested in me in that behalf, do hereby order as follows, that is to say:

I. Article VII. of the Heavy Motor Car (Ireland) Order, 1905, shall be amended by the addition of the following proviso:

Provided further that where a heavy motor car has all its wheels fitted with pneuma ic tyres and is us d for the purpose of carrying passengers for hire or reward—

(a) if the heavy motor car is a double deck vehicle the speed at which it may be driven on any highway shall not exceed fifteen miles an hour; and

(b) if the heavy motor car is not a double deck vehicle the provisions of this Article shall not apply to it.

II. Article Xa of the Heavy Motor Car (Ireland) Order, 1905, added to the said Order by the Heavy Motor Car (Ireland) (Amendment) Order, 1919, is hereby revoked, and in lieu thereof there shall be substituted the following article:

Article Xa.—Every heavy motor car used on any highway which has not all its wheels fitted with pneumatic tyres shall be fitted with a device so constructed and fixed and of such a character as will prevent mud or water being thrown by such heavy motor car upon any person or property, or upon any other vehicle.

III. This Order shall come into operation on the date hereof.

IV. This Order may be cited as the Heavy Motor Car (Amendment) Order, 1928, and the Heavy Motor Car (Ireland) Order, 1905, as amended by the Road Vehicles (Registration and Licensing) Regulations, 1921; the Heavy Motor Car (Ireland) (Amendment) Order, 1911; the Heavy Motor Car (Amendment) Order, 1921; the Heavy Motor Car (Amendment) Order, 1924; the Heavy Motor Car (Amendment) Order, 1925, and this Order may be cited together as the Heavy Motor Car Orders, 1905 to 1928.
