LICENCE TO EXPORT BUTTER (FORM AND FEES) ORDER, 1928.

WHEREAS it is enacted by sub-section (1) of section 46 of the Dairy Produce Act, 1924 (No. 58 of 1924), that the Minister for Lands and Agriculture may by order make regulations in regard to any matter or thing referred to in that Act as prescribed or as being or to be prescribed, but no such regulation shall be made in relation to the assessment or collection of fees without the consent of the Minister for Finance:

AND WHEREAS it is enacted by sub-section (1) of section 12 of the said Act that the said Minister may, upon the application of any person in the prescribed form and manner and upon payment by that person of the fees specified in the Third Schedule to that Act, grant to such person a licence to export the consignment of butter specified in the licence to such consignee (if any), by such route (if any), and subject to such conditions as are stated in the licence:

AND WHEREAS it is provided by the Third Schedule to the said Act that the fee on the grant of a licence to export butter under the said sub-section (1) of section 12 of the said Act on each package of butter to which such licence relates shall be as follows: where the package contains not more than twenty-eight pounds of butter, such fee, not exceeding one penny, as may be prescribed, and where the package contains more than twenty-eight pounds of butter, on every twenty-eight pounds or part of twenty-eight pounds of butter such fee, not exceeding one penny, as may be prescribed;

NOW I, PATRICK HOGAN, Minister for Lands and Agriculture, in exercise of the powers conferred on me by the Dairy Produce Act, 1924 (No. 58 of 1924), and of every and any other power me in this behalf enabling, do by this Order make the following regulations, that is to say:—

1. These regulations may be cited as the Licence to Export Butter (Form and Fees) Order, 1928.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these regulations the expression "the Act" means the Dairy Produce Act, 1924 (No. 58 of 1924).

4. An application under sub-section (1) of section 12 of the Act for a licence to export butter shall be in the form in the Schedule hereto.

5. An application under the said sub-section (1) of section 12 of the Act for a licence shall be lodged with the Minister for Lands and Agriculture at his Office in Dublin six days at least before the date on which the applicant proposes to export the butter in respect of which such licence is required and shall be accompanied by the appropriate fee prescribed by these regulations.

6. The fee payable on the grant of a licence on each package of butter to which such licence relates shall be as follows:—Where the package contains not more than twenty-eight pounds of butter, one penny, and where the package contains more than twenty-eight pounds of butter, on every twenty-eight pounds or part of twenty-eight pounds of butter a fee of one penny.
