CHURN MARKS ORDER, 1928.

WHEREAS it is enacted by sub-section (1) of Section 27 of the Dairy Produce Act, 1924 (No. 58 of 1924), that the Minister for Lands and Agriculture may by order make regulations in regard to (amongst other matters) the mode in and the means by which the prescribed marks are to be placed on packages of butter, and it is enacted by sub-section (2) of the said section that regulations made under the said section shall apply to all premises registered in any register kept in pursuance of the said Act, or to all premises registered in one or more of such registers, as may be prescribed in that behalf by the regulations respectively.

AND WHEREAS it is enacted by sub-section (1) of section 29 of the said Act that the said Minister may by Order make regulations prescribing the marks to be placed on every package or wrapper containing butter exported or consigned from or sold on any premises to which such regulations apply for the purpose of indicating, in addition to all or any of the matters therein particularly specified which are not material to this Order, any other matter which in the opinion of the said Minister should be indicated on such package or wrapper and it is enacted by sub-section (5) of the said section that regulations made under the said section shall apply to all premises registered in any register kept in pursuance of the said Act or to all premises registered in any one or more of such registers, as may be prescribed in that behalf by the regulations respectively.

AND WHEREAS it is enacted by sub-section (2) of section 46 of the said Act that any regulations made by the Minister under the said Act may relate to several matters in respect of which the power to make regulations is conferred by different sections of the said Act.

AND WHEREAS in the opinion of the said Minister the matters prescribed under section (1) of section 29 of the said Act hereinafter referred to are matters which should be indicated on every such package as aforesaid.

NOW I, PATRICK HOGAN, Minister for Lands and Agriculture, in exercise of the powers conferred on me by the Dairy Produce Act, 1924 (No. 58 of 1924), and of every and any other power me in this behalf enabling, do by this Order make the following regulations, that is to say:—

1. These regulations may be cited as the Churn Marks Order, 1928.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. These regulations apply to all premises registered in the register of creameries or the register of manufacturing exporters.

4. Every package containing butter exported or consigned from any premises to which these regulations apply shall have placed thereon in the manner hereinafter provided a mark (in this Order referred to as a churn mark) of the kind hereinafter specified for the purpose of indicating the churning from which such butter was made.

5. Every churn mark shall consist of a distinctive letter for each month of the year and a distinctive number for each churning, which numbers shall run consecutively from the beginning to the end of each month or from the beginning to the end of each year.

6. (1) Every churn mark shall, where the package is a box, be inscribed on the same side of such box as the marks prescribed by sub-paragraph (1) of paragraph 5 of the Dairy Produce Act, 1924 (Regulations under Part III) Order No. 1, 1925, are inscribed, and shall, where the package is a cask or keg, be inscribed on the same stave or set of adjoining staves as the said marks are inscribed and no churn mark or part of a churn mark shall be obscured by any hoop, label or otherwise.

(2) The letters and figures to be used for churn marks shall be half an inch in height.

(3) Every churn mark shall be inscribed by burning or printing the same in a dark brown colour on the package on which it is to be inscribed.
