STATUTORY RULES AND ORDERS. 1928. No. 5.

AIR NAVIGATION ACT, 1920, ADAPTATION ORDER, 1928.

WHEREAS it is enacted by section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922) that the Executive Council of Saorstát Eireann may from time to time by Order make all such general or specific adaptations of or modifications in any British Statute which in the opinion of the Executive Council are necessary in order to enable such statute to have full force and effect in Saorstát Eireann :

AND WHEREAS in the opinion of the Executive Council the adaptations and modifications intended to be made by this Order of the Air Navigation Act, 1920 (being a British Statute within the meaning of the said Adaptation of Enactments Act, 1922 ) are necessary in order to enable such statute to have full force and effect in Saorstát Eireann.

NOW, THE EXECUTIVE COUNCIL of Saorstát Eireann in exercise of the powers conferred on them by section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power them in this behalf enabling do hereby order as follows :—

1. This Order may be cited for all purposes as the Air Navigation Act, 1920, Adaptation Order, 1928.

2. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

3. In this Order the expression " the Act " means the Air Navigation Act, 1920.

4. Every mention or reference contained in section 7 of the Act of or to the Secretary of State shall be construed as a mention of or reference to an Executive Minister and every mention or reference contained elsewhere in the Act than in the said section 7 of or to the Secretary of State or a Secretary of State shall be construed as a mention of or reference to the Minister for Industry and Commerce, and the Act shall have effect accordingly.

5. Every mention or reference contained in the Act of or to the British Islands and British aircraft respectively shall be construed as a mention of or reference to Saorstát Eireann and Saorstát Eireann aircraft respectively, and the Act shall have effect accordingly.

6. Paragraph (f) of section 3 of the Act shall be construed and have effect as if the words " or from one British island to another " were omitted therefrom.

7. Sections 4 and 6 of the Act shall cease to have effect.

8. The reference contained in section 5 of the Act to the United Kingdom shall be construed as a reference to Saorstát Eireann and the said section shall have effect accordingly.

9. Subsection (1) of Section 7 of the Act shall be construed and have effect as if the expression " the Defence Forces of Saorstát Eireann " were inserted therein in lieu of the words " His Majesty's naval, military or air forces " now contained therein.

10. Section 8 of the Act shall be construed and have effect as if the expression " the Minister for Industry and Commerce " were inserted therein in lieu of the expression " the Air Council " wherever the latter expression occurs in the said section.

11. Section 16 of the Act shall be construed and have effect as if the several references to the Air Council now contained therein were omitted therefrom.

12. Subsection (1) of section 18 of the Act shall be construed and have effect as if the words " in the service of the State " were inserted therein in lieu of the words " in the service of His Majesty " now contained therein.
