S.I. No. 912/1927 - 08/01/1927: School Attendance Officers (Compensation) Order, 1927


DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS by sub-sections (4) and (5) of section 26 of the School Attendance Act, 1926 , it is enacted as follows :—

(4) Immediately upon the commencement of this Act the officers then existing of every school attendance committee appointed under the Irish Education Act, 1892, and existing at the commencement of this Act shall, save as is otherwise provided by this Act, be deemed to have been removed from their respective offices and shall be paid by the council or body by which the expenses of such committee were defrayed under that Act compensation in accordance with a scale to be fixed by the Minister for Local Government and Public Health after consultation with the Minister for Education but not exceeding in any case one-tenth of the annual salary of the officer for every completed year of his service, such salary being calculated at the rate of salary of which the officer was in receipt on the 1st day of November, 1925.

(5) All expenses incurred by a council or body in the execution of this section shall be defrayed out of the like rate or fund as that out of which the expenses of the school attendance committee were defrayed by such council or body.

AND WHEREAS in pursuance of section 27 of the said School Attendance Act, 1926 , the Minister for Education has by his Order bearing date the 20th day of December, 1926, fixed the 1st day of January, 1927, as the day on which the said section 26 shall come into operation:

NOW, THEREFORE, the Minister for Local Government and Public Health in exercise of the powers vested in him as aforesaid, does by this his Order, after consultation with the Minister for Education, direct and declare as follows, that is to say :—

1. The compensation payable to the officers of school attendance committees who have been removed from office in pursuance of sub-section (4) of section 26 of the School Attendance Act, 1926 , shall be in accordance with the following scale, namely, one-tenth of the annual salary of each such officer forevery completed year of his service ending on the 31st day of December, 1926; such salary being calculated at the rate of salary of which such officer was in receipt on the 1st day of November, 1925.

26. In computing for the purposes of this Order the annual salary of an officer the value of any bonus or addition to salary granted to him to meet the increased cost of living shall be included but only to the extent of 75 per cent. of the actual amount thereof of which the officer was in receipt on the 1st day of November, 1925, and the value of any allowances in money or in kind of which an officer was in receipt shall be excluded.

3. This Order may be cited as the School Attendance Officers (Compensation) Order, 1927.
