STATUTORY RULES AND ORDERS. 1927. No. 38.

JUDICIAL SAVINGS (APPORTIONMENT OF GRANT) ORDER, 1927.

WHEREAS by section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), it is enacted that wherever under any British statute any grant whether annual or capital is directed to be made by the Treasury out of the Consolidated Fund or by the Treasury or any other Government Department out of any other fund, and the amount of such grant is by such statute or otherwise fixed either for the whole of the late United Kingdom or for any part thereof which included the area now comprised in Saorstát Eireann, the Minister for Finance may by order apportion such amount between Saorstát Eireann and the rest of the area in respect of which such amount is fixed as aforesaid and may by such order fix the amount of such grant to be made under such statute in Saorstát Eireann :

AND WHEREAS by section 3 of the British Statute entitled the Supreme Court of Judicature (Ireland) Act, 1907, it is enacted that there shall be placed at the disposal of the Local Government Board for Ireland for the purposes of the Labourers (Ireland) Acts an annual sum, to be paid out of moneys provided by Parliament, equal to the reduction of charge upon the Consolidated Fund of the United Kingdom effected by that Act, and that section 13 of the British Statute entitled the Labourers (Ireland) Act, 1906, shall be construed as if the said annual sum were substituted therein for the sum mentioned in paragraph (c) of sub-section (1) of the said section 13 :

AND WHEREAS the reduction of charge upon the Consolidated Fund effected by the said Act amounted to £9,000 and the annual sum to be placed at the disposal of the Local Government Board for Ireland under the said Act was fixed accordingly at £9,000 :

AND WHEREAS the functions of the Local Government Board for Ireland are now vested, so far as regards Saorstát Eireann, in the Minister for Local Government and Public Health :

AND WHEREAS the said annual sum of £9,000 was fixed by the British Statute aforesaid for the whole of Ireland being a part of the late United Kingdom which included the area now comprised in Saorstát Eireann, and it is necessary that such sum should be apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was fixed as aforesaid and that the annual sum to be placed at the disposal of the Minister for Local Government and Public Health for the purposes of the Labourers (Ireland) Acts under section 3 of the statute aforesaid in Saorstát Eireann should be fixed :

NOW, THEREFORE, the Minister for Finance in Saorstát Eireann, in exercise and by virtue of the power in this behalf vested in the Minister for Finance by the Adaptation of Enactments Act, 1922 (No. 2 of 1922) and of every and any other power him in this behalf enabling, does hereby order as follows :—

1.—The annual sum fixed by section 3 of the Supreme Court of Judicature (Ireland) Act, 1907 as the sum, to be paid out of moneys provided by Parliament, equal to the reduction of charge upon the Consolidated Fund of the United Kingdom effected by that Act and to be placed at the disposal of the Local Government Board for Ireland for the purposes of the Labourers (Ireland) Acts which sum amounted as aforesaid to the sum of £9,000 (nine thousand pounds), is hereby apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was fixed by the said Act as follows, that is to say :—

(a) in respect of Saorstát Eireann, the sum of £7,352 (seven thousand three hundred and fifty-two pounds), and

(b) in respect of the rest of the area aforesaid, the sum of £1,648 (one thousand six hundred and forty-eight pounds).

2. The annual sum to be placed in Saorstát Eireann at the disposal of the Minister for Local Government and Public Health under section 3 of the Supreme Court of Judicature (Ireland) Act, 1907, in lieu of the said annual sum of £9,00 (nine thousand pounds) shall be the sum of £7,352 (seven thousand three hundred and fifty-two pounds).

3. In this Order the expression " Saorstát Eireann " means the area for the time being within the jurisdiction of the Parliament and Government of Saorstát Eireann.

4. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

5. This Order may for all purposes be cited as the Judicial Savings (Apportionment of Grant) Order, 1927.
