S.I. No. 4/1927 - The School Attendance (County Borough of Limerick) Order, 1927.


SCHOOL ATTENDANCE (COUNTY BOROUGH OF LIMERICK) ORDER, 1927.

WHEREAS it is enacted by sub-section (1) of section 14 of the School Attendance Act, 1926 (No. 17 of 1926) that if and whenever the Minister for Education is satisfied that a school attendance committee is not duly and effectually discharging its duties under that Act the said Minister may by order dissolve such committee, and by sub-section (5) of the said section 14 it is enacted that whenever a school attendance committee appointed under the Irish Education Act, 1892, which should under the said School Attendance Act, 1926 , become the first school attendance committee of a school attendance area is at the commencement of the last-mentioned Act not in existence, such first school attendance committee shall for the purpose of the said section now in recital be deemed to have come into existence under that Act and may be deemed by the Minister at any time after the passing of that Act not to be discharging its duties under that Act duly and effectually and may dissolved under the said section accordingly:

AND WHEREAS the said Act contains divers provisions consequential on the dissolution of a school attendance committee under the said section 14:

AND WHEREAS the school attendance committee which should under the said Act have become the first school attendance committee for the County Borough of Limerick was not in existence at the commencement of the said Act on the 1st day of January, 1927, in the said County Borough:

AND WHEREAS it is expedient that such provision as is hereinafter set forth should be made for the execution of the said Act in the County Borough of Limerick:

AND WHEREAS the Minister for Education has consulted with the Minister for Justice in respect of so much of this Order as is made under section 9 of the said Act and the Minister for Justice has consented to so much of this Order as is made under paragraph (b) of sub-section (1) of section 14 of the said Act:

NOW, I, JOHN MARCUS O'SULLIVAN, Minister for Education, in pursuance and in exercise of the powers conferred on me by the School Attendance Act, 1926 (No. 17 of 1926) and of every and any other power me in this behalf enabling, do hereby order as follows:—

1. This Order may be cited for all purposes as the School Attendance (County Borough of Limerick) Order, 1927.

2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order the expression " the Act " means the School Attendance Act, 1926 (No. 17 of 1926).

4. The school attendance committee for the County Borough of Limerick which by virtue of sub-section (5) of section 14 of the act is for the purposes of that section deemed to have come into existence under the Act is hereby deemed not to be discharging its duties under the Act duly and effectually and is hereby dissolved accordingly.

5. the Act shall apply to the County Borough of Limerick as if that County Borough was not mentioned in the Schedule to the Act.

6. The County Borough of Limerick shall be a school attendance area, and for the purpose of identification shall be numbered one hundred and ten, and the enforcing authority in such school attendance area shall be the officer of the Gárda Síochána holding the rank of superintendent and stationed in the County Borough of Limerick.
