BY-LAW No. 378 ESCALLOP FISHERIES

BANTRY BAY AND DUNMANUS BAY

I, FIONAN O'LOINGSIGH, Minister for Fisheries, by virtue and in exercise of the powers vested in me by the Fisheries Act, 1925 , and of every other power enabling me in this behalf, do MAKE AND ORDAIN THE FOLLOWING BY-LAW :—

(1.) It is prohibited from the first day of April to the thirtieth day of September in every year, both said days inclusive, to take any Escallop from that part of the sea off the coast of County Cork lying between the mainland of the said County and an imaginary straight line drawn from the western extremity of Mizen Head to the Western extremity of Crow Head.

(2.) Every person who shall take any Escallop of a smaller size than four and a half inches measured across its greatest width from the aforesaid part of the sea shall forthwith return the same to the sea.

(3.) It is prohibited to bring to land, or to sell, expose for sale, purchase, carry or have in possession within the aforesaid part of the sea or within two miles of High Water Mark on the shores thereof any Escallop of a smaller size than four and a half inches measured across its greatest width.

(4.) Each and every person offending against this by-law shall forfeit and pay for each offence a sum not exceeding Five Pounds.

(5.) This by-law may be cited for all purposes as the Bantry and Dunmanus Bays Escallop By-Law, No. 378, 1926.

NOTE.—Under the provisions of the Fisheries Act, 1925 , this by-law will come into operation on the twenty-eighth day after the above date.
