STATUTORY RULES AND ORDERS. 1926. No. 3.No. 3/1926: COUNTY BOARDS OF HEALTH (ASSISTANCE) (AMENDMENT) ORDER, 1926

WHEREAS in pursuance of the Poor Relief (Ireland) Acts, 1838 to 1914, and the Local Government (Temporary Provisions) Act, 1923 , and of every County Scheme under the last mentioned Act, the Minister for Local Government did, by the County Boards of Health (Assistance) Order, 1924, amongst other things require every County Board of Health established under or in pursuance of a county scheme as aforesaid to appoint subject to the approval of the said Minister a Superintendent Assistance Officer to perform the duties therein specified in relation to such office or by any Order of the said Minister for the time being in force or to assign with the like approval such duties to the Secretary or other officer of a County Board of Health:

AND WHEREAS it is expedient to amend and modify the provisions of the said Order in manner hereinafter appearing:

NOW THEREFORE I, the Minister for Local Government and Public Health, in exercise of the powers vested in me in that behalf do by this My Order order and direct as follows:—

1. Article 10 of the County Boards of Health (Assistance) Order, 1924, is hereby revoked and the said Order shall henceforth be read and construed as if there were therein inserted the following article in place of and in substitution for the said Article 10 hereby revoked:—

10 (1) A Board of Health shall appoint such and so many fit persons as the Minister shall from time to time direct or approve to hold the office of Superintendent Assistance Officer and to perform the duties specified by the rules and regulations in force for the time being to be the duties of such office and shall assign to each such officer such district as the Minister shall from time to time direct or approve.

(2) A Board of Health may and shall if so directed by the Minister appoint an officer of such Board to hold the office of Superintendent Assistance Officer under the foregoing sub-article (1) of this article.

(3) Any person appointed by a Board of Health to hold the office of Superintendent Assistance Officer shall satisfy the Minister either by examination or otherwise according as the Minister shall require of his qualifications and fitness to hold the said office.

(4) No person shall be appointed to hold the office of Superintendent Assistance Officer unless he shall have attained the age of twenty-five years.

(5) No person other than an officer of a Board of Health shall hold the office of Superintendent Assistance Officer unless he shall devote the whole of his time to the performance of his duties.

(6) Every person appointed to hold the office of Superintendent Assistance Officer shall hold office on probation for one year from the date of appointment and shall at the expiration of such year cease to hold the office unless the Minister shall be satisfied that such person has satisfactorily performed the duties of his office during such year.

(7) Notwithstanding anything contained in sub-article (5) of this Article a Superintendent Assistance Officer may, with the consent of the Minister, hold an office under a local government authority other than a Board of Health.

2. This Order may be cited as the County Boards of Health (Assistance) (Amendment) Order, 1926.
