21/09/1925: Fishery District Order: Ballyshannon


DEPARTMENT OF FISHERIES.

WHEREAS it is enacted by Section 27 of the Fisheries Act, 1925 (No. 32 of 1925), that the Minister for Fisheries may by order create new fishery districts and divide any fishery district so created into two or more electoral divisions and appoint the number of conservators (but not more than nine nor less than three) to be elected for any electoral division so created and provide for the election of persons to act as such conservators until the next triennial elections.

AND WHEREAS it is also enacted by the said section 27 of the said Act that whenever the said Minister by an order made under that section creates a new fishery district or electoral division he shall by such order appoint the boundaries of such district or division and shall annex to such order a suitable map showing such boundaries.

AND WHEREAS the fishery district known as No. 13 or Ballyshannon District and created by an order heretofore made is situate partly within and partly outside Saorstát Éireann and it is expedient that in lien of the said No. 13 or Ballyshannon District a new fishery district should be created to comprise so much of the said No. 13 or Ballyshannon District as is within Saorstát Éireann.

NOW I, Fionan O'Loingsigh, Minister for Fisheries, in exercise of the power conferred on me by Section 27 of the Fisheries Act, 1925 (No. 32 of 1925) and of every and any other power me in this behalf enabling do hereby order as follows:—

1. This Order may be cited for all purposes as the Ballyshannon Fishery District Order, 1925.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. A new fishery district is hereby created to be called and known as the No. 13 or Ballyshannon District, and the boundaries stated in the Schedule to this Order and shown on the Map annexed hereto are hereby appointed to be the boundaries of such fishery district.

4. The said new fishery district created by this Order is hereby divided into two electoral divisions and the several boundaries stated in the Schedule to this Order and shown on the Map annexed hereto are hereby appointed to be the respective boundaries of such electoral divisions.

5. It is hereby appointed that the number of conservators to be elected for the said two electoral divisions respectively shall be six conservators for each such electoral division.

6. This Order shall come into force on the 3rd day of October, 1925, and a board of conservators for the new fishery district created by this Order shall be elected on the 5th day of October, 1925.

BALLYSHANNON DISTRICT,

From Mullaghmore, Co. Sligo, to Rossan Point, Co. Donegal.

A. The whole of the sea along the Coast between Mullaghmore, Co. Sligo, and Rossan Point, Co. Donegal, and around any Islands or Rocks situate off the same with the whole of the Tideway along said coasts and Islands and the whole of the Tidal portions of the several Rivers and their Tributaries flowing to the said coast between said points.

B. The whole of the Upper of Freshwater portions of all Rivers, Lakes, and their Tributaries within Saorstát Éireann whose waters flow into Tidal Electoral Division A.
