THE LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923 .

WATERFORD COUNTY SCHEME.

To the Council of the Administrative County of Waterford; to the Council of the County Borough of Waterford; to the Waterford County Board of Health: and to all whom it may concern:

WHEREAS by an Order under my Seal of Office bearing date the 10th day of July, 1923, called the Waterford County Scheme Order, 1923, I, the Minister for Local Government and Public Health, in pursuance of Section 5 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act") did amend and modify the existing Joint County Scheme relating to the County of Waterford and the County Borough of Waterford as set out in the First Schedule to the Act in such way as to bring it into conformity with the provisions of the scheme set out in the Schedule to the said Order (which said last-mentioned provisions are in this Order referred to as the Waterford County Scheme:

AND WHEREAS the Waterford County Scheme has come into operation, and I, the Minister for Local Government and Public Health, deem it necessary further to amend the Waterford County Scheme in such manner hereinafter appearing as to bring the same into conformity with the provisions of the Local Government Act, 1925 , and did give to the Council of the Administrative County of Waterford and the Council of the County Borough of Waterford one month's notice of my intention to make the said amendments, and have taken into consideration any representation which has been made to me by the said Councils within such month in respect of the said amendments:

NOW THEREFORE I, the Minister for Local Government and Public Health, in exercise of the powers given to me by Section of the Act, and of all other powers in this behalf enabling me, the said month having expired, do by this my Order, amend the Waterford County Scheme in manner following, that is to say:

1. Articles number 3 to 11 and 14 and 21 shall be, and the same are hereby revoked.

2. In Article 2 for the words "Waterford County Board of Health" there shall be substituted the words "Waterford County Board of Public Assistance" (hereinafter referred to as the "Board of Public Assistance") and references in other Articles to "Board of Health" shall be read and construed as references to the Board of Public Assistance.

3. The following new Article shall be added after Article 2:—

(i) The Board of Public Assistance shall consist of seventeen members.

(ii) The Corporation shall elect seven of their members to be members of the Board of Public Assistance at their quarterly meeting held next after a triennial election, and the election of such members shall be part of the first business to be transacted thereat.

(iii) The County Council shall elect ten of their members to be members of the Board of Public Assistance, and the provisions of Section 12 of the Local Government Act, 1925 , and of the Second Schedule to the said Act, shall apply to such election as if the County were a county health district established under the said Act and such ten members were the members of a board of health for such county health district within the meaning of the said Act.

(iv) Subject to the provisions of paragraphs (i), (ii) and (iii) of this Article the provisions of Sections 12 and 13 of the Local Government Act, 1925 , and of the Second Schedule to the said Act, shall apply to the Board of Public Assistance as if the County were a county health district under the said Act and the Board of Public Assistance were a board of health for such county health district within the meaning of the said Act.

4. Paragraph (ii) of Article 13 shall be amended by the addition thereto after the word "Guardians" of the words "in such other manner as may be prescribed."

5. This Order may be cited as the Waterford County Scheme (General Amendment) Order, 1925, and shall come into operation on and from the 6th day of July, 1925.
