THE LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923 .

TIPPERARY, SOUTH RIDING, COUNTY SCHEME.

To the Council of the Administrative County of Tipperary, South Riding; to the Tipperary, South Riding, County Board of Health; and to all whom it may concern:

WHEREAS by an Order under my Seal of Office bearing date the 18th day of January, 1924, called the Tipperary (South Riding) County Scheme Order, 1924, I, the Minister for Local Government and Public Health, in pursuance of Section 4 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act,") did confirm the scheme for the relief of the poor in the Administrative County of Tipperary, South Riding, prepared and submitted to me by the Council of the said Administrative County with such modifications, omissions and additions as should bring it into conformity with the provisions set forth in the Schedule to my said Order (which said provisions are in the said Order and this Order, referred to as the Tipperary (South Riding), County Scheme):

AND WHEREAS by the Tipperary (South Riding) County Scheme, the Board of Guardians of the Clonmel Union was dissolved and the powers and duties of the said Board transferred to the body established under the said County Scheme, called the Tipperary, South Riding, County Board of Health:

AND WHEREAS by Sub-section (2) (a) of Section 7 of the Act, it is provided in effect that the debts and liabilities of the Board of Guardians of the Clonmel Union shall become and be debts and liabilities of the Council of the Administrative County of Tipperary, South Riding, and subject to the provisions of the Act and of the Tipperary (South Riding) County Scheme, shall be defrayed by the said Council out of the like property and funds as such debts and liabilities would have been defrayed if the Act had not been passed:

AND WHEREAS the former workhouse of the Clonmel Union is occupied by the Tipperary (South Riding) County Board of Health, and is being used for the purposes of a District Hospital under the Tipperary (South Riding) County Scheme:

AND WHEREAS it is expedient to provide for the recoupment by the Tipperary (South Riding) County Board of Health of any sums paid or to be paid by the Council of the Administrative County of Tipperary, South Riding, in respect of loans borrowed by the Board of Guardians of the Clonmel Union for the construction or structural alteration or improvements of the Workhouse of the said Union, the liability for the repayment of which became a liability of the said Council under the said Sub-section (2) (a) of Section 7 of the Act:

AND WHEREAS the Tipperary (South Riding) County Scheme has come into operation, and I, the Minister for Local Government and Public Health, deem it necessary to amend the said Scheme in manner hereinafter appearing, and did on the 20th day of May, 1925, give to the Council of the Administrative County of Tipperary, South Riding, one month's notice of my intention to make the said amendment, and have taken into consideration any representation which has been made to me by the said Council within such month in respect of such amendment:

NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the powers given to me by Section 5 of the Act, and of all other powers in this behalf enabling me, the said month having expired, do by this my Order, order and direct as follows, that is to say:—

1. The Tipperary (South Riding) County Scheme shall be amended by the addition of the following paragraph after paragraph (ii) of Article 13 of the said County Scheme, that is to say:—

(iii) The Board of Health shall recoup to the County Council any sums paid by the County Council in the local financial year ended on the 31st day of March, 1925, or any subsequent financial year, in respect of the repayment of loans borrowed by the Board of Guardians of the Clonmel Union for the construction or structural alteration or improvement of the workhouse of the Clonmel Union.

2. This Order may be cited as the Tipperary, South Riding, County Scheme (Amendment) Order, 1925.
