COUNTY SCHEME ORDER, GENERAL AMENDMENT, 1925.

THE LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923 .

To the Councils of the several administrative counties named in the First Schedule to this Order; to the several county boards of health for the said counties; to the persons named in the second schedule to this order who have been appointed in pursuance of section 12 of the Local Government (Temporary Provisions) Act, 1923 , to perform the duties of certain of the said councils and county boards of health; and to all whom it may concern:

WHEREAS in exercise of the powers vested in me in that behalf by the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act") I, the Minister for Local Government and Public Health, did by the orders mentioned in the Third Schedule to this Order confirm with modifications, omissions and additions, schemes submitted to me under the Act for the administration of the relief of the poor or did amend and modify existing county schemes for the administration of the relief of the poor in the several counties to which such schemes severally relate in such manner as to bring the provisions of such schemes into conformity with the provisions set forth in the Schedule to the said Orders (which latter provisions are in this order referred to as "the County Schemes").

AND WHEREAS the County Schemes have come into operation and I, the Minister for Local Government and Public Health, deem it necessary further to amend the county schemes in such manner hereinafter appearing as to bring them into conformity with the provisions of the Local Government Act, 1925 , and did give to the councils of the counties to which the county schemes severally relate, one month's notice of my intention to make the said amendments and have taken into consideration any representations which have been made to me by the said councils within such month in respect of the said amendments:

NOW THEREFORE I, the Minister for Local Government and Public Health, in exercise of the powers vested in me by section 5 of the Act and of all other powers in this behalf enabling me, do by this my Order, order and direct as follows, that is to say:

1. The articles numbered 3 to 11 and 14 in each of the county schemes and in addition the provisions of Part IV. (if any) contained in any of the county schemes shall be and the same are hereby revoked.

2. In each of the county schemes, the following new article shall be added after article 2 of each of the county schemes:

The provisions of sections 12 and 13 of the Local Government Act, 1925 , and of the Second Schedule to the said Act shall apply to the said County Board of Health (hereinafter referred to as the Board of Health) as if the county were a county health district under the said Act and the Board of Health were the board of health for such district within the meaning of the said Act.

4. Paragraph (ii) of Article 13 of each of the County Schemes shall be amended by the addition thereto after the word "Guardians" of the words "or in such other manner as may be prescribed."

5. Article 13 of each of the County Schemes shall be amended by the addition thereto of the following new paragraph:—

(iii) The Board of Health shall be subject to such conditions or restrictions in relation to expenditure as the County Council may impose with the consent of the Minister.

6. This Order may be cited as the County Schemes (General Amendment) Order, 1925, and shall come into operation on and from the 6th day of July, 1925.
