ADAPTATION OF CHILDREN'S ACT, 1908, ORDER, 1925.

To each County Board of Health, and to all whom it may concern:

WHEREAS it is enacted in effect by Section 20 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act"), that the Minister for Local Government and Public Health may amongst other things make such adaptations of any existing enactment relating to any matter dealt with or affected by the Act as appear to him necessary or expedient for carrying into effect the Act or the County Schemes made thereunder:

AND WHEREAS by the Children Act, 1908, certain powers and duties were given and imposed to and upon Boards of Guardians of poor law unions:

AND WHEREAS by the several county schemes made under or amended in pursuance of the Act, boards of guardians of poor law unions have been abolished in the several counties of Saorstát Eireann with the exception of the County of Dublin, and their powers and duties in relation to the relief of the poor have been transferred to county boards of health established under such schemes:

AND WHEREAS the Children Act, 1908, is an existing enactment as defined in Section 21 of the Act, and is affected by the Act, and it appears to me, the Minister for Local Government and Public Health, necessary or expedient for carrying into effect the Act or the County Schemes made thereunder, to make therein the adaptations hereinafter appearing:

NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the powers given to me by Section 20 of the Act and of all other powers in this behalf enabling me, do by this my Order, order as follows, that is to say :—

The Children Act, 1908, shall be read, construed, and have effect as if references therein to

(a) a "board of guardians" included references to a County Board of Health established under a County Scheme;

(b) a "poor law union" included references to the area of administration of a county board of health;

(c) the "funds of the union" included references to the funds of a county board of health;

(d) a "workhouse" shall include references to a county home or childrens home provided by a county board of health under a county scheme.
