13/02/1925: Adaptation (Vaccination (Ireland) Acts) Order, 1925

To the Council of each County Borough ; to the Council of each Urban District ; to the Council of each Rural District ; and to all whom it may concern:

WHEREAS it is enacted by section 9 of the Local Government (Temporary Provisions) Act, 1923 , (No. 9 of 1923) (hereinafter referred to as the Act of 1923) that when the board of guardians of any Union is abolished by any County Scheme, the powers and duties of such board of guardians under the Vaccination (Ireland ) Acts in any county borough, urban or rural district forming part of such union shall be transferred to the Council of such borough or urban or rural district:

AND WHEREAS the boards of guardians of the several unions in Saorstát Eireann with the exception of the Board of Guardians of the Balrothery Union; the Board of Guardians of the Dublin Union; and the Board of Guardians of the Rathdown Union have been abolished by County Schemes under the Act of 1923.

AND WHEREAS the Vaccination (Ireland) Acts as defined in Section 12 of the Vaccination Amendment (Ireland) Act, 1879, are existing enactments within the meaning of section 20 of the Act of 1923, and it appears to me the Minister for Local Government and Public Health, necessary or expedient for carrying into effect the Act of 1923, to make the adaptations hereinafter appearing in the said enactments:

NOW, THEREFORE, I, the Minister for Local Government and Public Health in exercise of the powers vested in me by section 20 of the Act of 1923, and the Vaccination (Ireland) Acts, and of all other powers in this behalf enabling me, do by this my Order, order and direct as follows :—

1. This Order may be cited as the Adaptation (Vaccination (Ireland) Acts), Order, 1925.

2. In this Order the expression " the Vaccination (Ireland) Acts " has the same meaning as in section 12 of the Vaccination Amendment (Ireland) Act, 1879.

3. In the application of the Vaccination (Ireland) Acts, to the council of a county borough, or urban, or rural district to which the powers and duties of a board of guardians thereunder have been transferred by section 9 of the Act of 1923 the following adaptations of the said Acts and of the Schedules thereto, with the exception of section 11 of the Vaccination Amendment (Ireland) Act, 1879, shall, save where inconsistent with the other provisions of this Order be made :—

(1) For " committee of management ", "board of guardians ", " guardians " and " guardians of the union ", there shall be substituted " council of a county borough, urban or rural district ", as the case requires.

(2) For " medical officer " and " dispensary medical officer " there shall be substituted " medical officer of health " as the case requires.

(3) For " union " there shall be substituted, " county borough, urban or rural district " as the case requires.

(4) For " dispensary district " there shall be substituted " dispensary district within, or in so far as it is situate within, a county borough, urban or rural district " as the case requires.

4. In Section 4 of the Vaccination (Ireland) Act, 1858, for the words from " Electoral Divisions " to the end of the section, there shall be substituted the words, " rate or fund out of which are defrayed the expenses of the council of the county borough, urban or rural district, as the case may be, in the execution of the Public Health (Ireland) Acts, 1878 to 1919."

5. In Section 10 of the Vaccination Amendment (Ireland) Act, 1879, for " out of the poor rates of the union in which the neglect or default shall have arisen ", there shall be substituted " by the Council of the county borough, urban or rural district, as the case may be, in which the neglect or default shall have arisen, out of the rate or fund out of which are defrayed the expenses incurred by such council in the execution of the Public Health (Ireland) Acts, 1878 to 1919 ".

6. In the Dispensary (County Boards of Health) Rules and Regulations, 1923, the regulations therein contained with respect to the duties of a dispensary medical officer under the Vaccination (Ireland) Acts, shall have effect as if references therein to a dispensary medical officer were construed as references to a medical officer of health of a dispensary district.
