Translation.

To the Council of each County Borough ; to the Council of each Administrative County ; to the Council of each Urban District ; and to all whom it may concern :

WHEREAS by Section 35 of the Local Government Act, 1925 , it is enacted in effect amongst other things that the Council in whom the duty of maintaining any road is vested under that Act may grant to any person a licence to erect, construct, place and maintain a petrol pump, on, in or under such road; that a licence under the said section may be granted by a Council for such period and under such conditions as the Council may prescribe; and that the Minister for Local Government and Public Health may make regulations prescribing the amount of the fee to be paid to a Council for the grant of a licence under the said section :

NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the powers vested in me by sub-section (6) of section 35 of the said Act do hereby make the following regulations, that is to say :—

1. These Regulations may be cited as the " Petrol Pumps (Fees) Regulations, 1925 ".

2. Where a licence to erect, construct, place and maintain a petrol pump on, in or under a road is granted by a Council for a period of one year, the amount of the fee to be paid to such Council for such grant shall be—

(a) if the road is situate in a county borough—five guineas, or

(b) if the road is situate in an urban district whose population exceeds three thousand according to the last published census for the time being—three guineas, or

(c) if the road is situate in an urban district whose population does not exceed three thousand according to the last published census for the time being, or in a town having commissioners under the Towns Improvement (Ireland) Act, 1854—two guineas, or

(d) in the case of any other road—one guinea.

3. Where the licence is granted by a County for a period other than one year the amount of the fee to be paid to such Council for such grant shall bear the same proportion to the amount of the fee payable for a grant of such licence for one year under the preceding article as such period bears to one year.
