HEAVY MOTOR CAR (AMENDMENT) ORDER, 1925.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

To the Councils of the several administrative Counties, County Boroughs, Boroughs and Urban Districts; and to all others whom it may concern:

WHEREAS by the Heavy Motor Car (Ireland) Order, 1905, (hereinafter referred to as "the Principal Order"), the Local Government Board for Ireland, in exercise of the powers conferred on them by Section 6 of the Locomotives on Highways Act, 1896, and by Section 12 of the Motor Car Act, 1903, did make regulations with respect to the use on highways of the class of motor cars therein described and referred to as "heavy motor cars," and by the said regulations did increase the maximum weight of a motor car and any vehicle drawn thereby, subject to the conditions as to the use and construction of the vehicle made by the said regulations;

AND WHEREAS the powers conferred on the said Board by the said Acts are now vested in me, the Minister for Local Government and Public Health;

AND WHEREAS it is now expedient to amend the Principal Order and the said regulations in the manner hereinafter appearing.

NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the powers vested in me by Section 6 of the Locomotives on Highways Act, 1896, and by Section 12 of the Motor Car Act, 1903, and of all other powers enabling me in this behalf do hereby order as follows, that is to say:—

1. Article 5 of the Principal Order shall be amended by the deletion therefrom of sub-article (2) and the substitution of a new sub-article as follows, that is to say:—

"(2) (a) The registered axle weight of the axle of a heavy motor car shall not exceed eight tons.

(b) The sum of the registered axle weights of all the axles of a heavy motor car used on a public road in a county borough shall not exceed twelve tons.

(c) The sum of the registered axle weights of all the axles of a heavy motor car used on a public road outside a county borough shall not exceed nine tons, unless such heavy motor car has been, before the date of this Order, licensed in Saorstát Eireann under the provisions of Section 13 of the Finance Act, 1920, and used on a public road in Saorstát Eireann, and in such latter case shall not exceed twelve tons.

2. (1) This Order shall be read as one with the Principal Order.

(2) This Order may be cited as "the Heavy Motor Car (Amendment) Order, 1925," and this Order and the Principal Order may be cited together as "the Heavy Motor Car Orders, 1905 and 1925."
