DAIRY PRODUCE ACT, 1924 (REGULATIONS UNDER PART V.) ORDER No. 1, 1925.

DEPARTMENT OF LANDS AND AGRICULTURE.

WHEREAS Parts I. and V. of the Dairy Produce Act, 1924 (No. 58 of 1924), came into operation on the 8th day of June, 1925, by virtue of an Order of the Minister for Lands and Agriculture made under Section 1 of that Act:

AND WHEREAS it is enacted by Section 46 of the said Dairy Produce Act, 1924 , that the said Minister may by order make regulations in regard to any matter or thing referred to in that Act as prescribed or as being or to be prescribed, but no such regulation shall be made in relation to the assessment or collection of fees without the consent of the Minister for Finance:

NOW I, Patrick Hogan, Minister for Lands and Agriculture, in exercise of the power conferred upon me by the Dairy Produce Act, 1924 , and of every and any other power me in that behalf enabling do by this my Order make the Regulations following, that is to say:

1. This Order may be cited as the Dairy Produce Act, 1924 (Regulations under Part V.) Order No. 1, 1925.

2. In this Order the expression "the Act" means the Dairy Produce Act, 1924 .

3. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

4. For the purpose of determining in accordance with Sub-section (4) of Section 39 of the Act whether milk is stale regard shall be had to the condition of the milk when heated to boiling point, and any milk which coagulates when so heated shall be deemed to be stale milk.

5. The certificate of the result of every analysis made by or under the direction of the analyst appointed for the purposes of Section 44 of the Act shall be in the form shown in the Schedule hereto.

6. The fee for the purpose of Clause (g) of Sub-section (1) of Section 44 of the Act shall be one guinea, and shall be payable to the Principal Chemist of the State Laboratories.
