THE LIVE STOCK BREEDING REGULATIONS, 1925.

LIVE-STOCK BREEDING REGULATIONS, 1925.

WHEREAS it is enacted by section 20 of the Live Stock Breeding Act, 1925 (No. 3 of 1925), that the Minister for Lands and Agriculture may by order make regulations in regard to any matter or thing referred to in that Act as prescribed or to be prescribed but that no regulation shall be made in relation to the amount or collection of fees without the consent of the Minister for Finance,

AND WHEREAS it is enacted by sub-section (1) of section 5 of the said Act that the said Minister may by regulations made under that Act declare that any particular breed or breeds or any particular type or types of bull is or are unsuitable for any specified area or areas but that the said Minister shall not make any such regulation until he has consulted the consultative council established under that Act in regard thereto and that the Minister in making any such regulation shall take into consideration any advice in regard thereto given to him by the said Council,

AND WHEREAS before making this Order the said Minister has consulted the consultative council established under the said Act in regard to so much of the regulations made by this Order as relates to any of the matters referred to in section 5 of the said Act and in the making of so much as aforesaid of the said regulations has taken into consideration any advice in regard thereto given to him by the said Council,

NOW I, PATRICK HOGAN, Minister for Lands and Agriculture, in exercise of the powers conferred on me by the Live Stock Breeding Act, 1925 and every and any other power me in this behalf enabling do by this Order make the following Regulations that is to say :—

1. These regulations may be cited as the Live Stock Breeding Regulations, 1925.

2 Definitions.

2. In these Regulations unless the context shall require a different construction :—

(1) The expression" the Act " means the Live Stock Breeding Act, 1925 .

(2) The word " bull " means any uncastrated male animal of the bovine species of the prescribed age.

3 Interpretation.

3. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

4 Age of Bull.

4. For the purposes of the Act and of these Regulations bulls calved in the months of January, February, March, April, May and June of any year shall be of the prescribed age on the 31st March in the year following, and bulls calved in the months of July, August, September, October, November, and December shall be of the prescribed age on the 30th September in the year following. Provided that all bulls calved on or before the 31st December, 1924, shall be of the prescribed age on the 30th September, 1925.

5 Application for licence and Fee for licence and duplicate thereof.

5. (1) An application for a licence to keep a bull shall be made in the form or to the effect stated at A in the Schedule to these Regulations and shall be lodged with the Minister not later than the thirty-first day of July in the case of bulls calved in the months of July, August, September, October, November, and December of the preceding year, and not later than the thirty-first day of January in the case of bulls calved in the months of January, February, March, April, May and June of the preceding year. Provided that the applications in respect of all bulls calved on or before the 31st December, 1924, shall be lodged with the Minister not later than the 31st July, 1925.

(2) The fee payable for a licence to keep a bull shall be Five Shillings.

(3) The additional fee payable for a licence when the application is not made in the prescribed time shall be five shillings, save in a case in which a special inspection is necessary when the additional fee shall be two pounds.

(4) Any person requiring a duplicate licence under section 2 (4) of the Act shall furnish to the Minister a signed declaration stating fully the circumstances in which the original licence was lost or destroyed and shall furnish such further information in regard to such loss or destruction as shall be required by the Minister. The fee payable in respect of a duplicate licence shall be two shillings and sixpence.

6 Condition as to inspection and examination.

6. The fee payable for a special inspection and examination under sub-section (3) of section 3 of the Act shall be two pounds.

7 Marking of bulls.

7. (1) The Minister may cause any bull which is accepted for licence to be marked by tatooing on the right ear. The mark shall consist of a shamrock and a letter and a number.

(2) The Minister may cause any bull which is rejected for licence to be marked by tatooing on the right ear with the letter R.

8 Restrictions to ensure suitability of bull for district.

8. It is hereby declared that bulls of all breeds other than the Kerry breed are unsuitable for the area which is comprised within the following boundary :

" Commencing at Tullig Quay, where the river Ahnagloghlea flows into Castlemaine Harbour thence by that river to a point where it meets the direct road running from Tullig to Killorglin thence by that road to Killorglin town thence through that town by the main road leading from Killorglin to Meanus to Ardmoneel cross-roads thence southerly by the road to Barry's Cross thence by the road to Ownagarry Bridge thence by the road passing Shannera cross-roads to Kilgobnet cross roads thence by the road passing Gaddagh Bridge, Cullenagh Lower and Beaufort cross-roads to Beaufort Bridge thence by the River Laune to the point where that river flows out of Lough Leane thence by the south shore of that Lough to the point where the river Flesk flows into the Lough thence by that river to Glenflesk Bridge thence by the main road to Garries Bridge thence by the road running easterly to Owgarriv Bridge thence by the Owgarriv River and the Coomageartuby River to its source thence to the nearest point on the County Boundary (Cork-Kerry) thence by that boundary to the point where it meets the road running from Snave Bridge to Drehideighteragh Bridge thence by that road to Snave Bridge and thence by the sea coast to the point of commencement, but including Valencia Island."

For the purposes of this Regulation the following shall be the prescribed herd books within the meaning of section 5 (4) of the Act :—

Coates Herd Book published by the Shorthorn Society of Great Britain and Ireland.

The Aberdeen Angus Herd Book published by the Aberdeen Angus Cattle Association.

The Hereford Herd Book published by the Hereford Cattle Society.

The Galloway Herd Book published by the Galloway Cattle Society.

The Friesian Herd Book published by the British Friesian Cattle Society.

The Jersey Herd Book published by the Jersey Cattle Society.

The Red Poll Herd Book published by the Red Polled Cattle Society.

The Lincoln Red Herd Book published by the Lincoln Red Cattle Society.

The Ayrshire Herd Book published by the Ayrshire Cattle Society.

9 Permits for fattening for slaughter.

9. (1) The owner of a bull may apply in the form or to the effect as at B in the Schedule to these Regulations for a permit to keep at the place specified in such permit a bull for the purpose of fattening it for slaughter. The conditions under which such permit will be granted are—

(a) That the bull shall not be used for service purposes.

(b) That the permit shall be returned to the Department of Agriculture, Upper Merrion Street, Dublin, immediately after the bull to which it refers has been slaughtered, and in any case not later than the date of expiry of the permit as specified thereon.

(2) The fee for a permit to keep a bull for fattening for slaughter shall be two shillings and sixpence.

10 Transfer of licences and permits.

10. (1) Any person claiming to be a transferee of a bull within the meaning of sub-section (2) of section 9 of the Act and desiring to have the licence or permit in respect of the bull transferred to him shall furnish to the Minister particulars in writing of the event entitling him to such transfer and shall furnish to the Minister such further information (if any) of such event as the Minister shall require.

(2) Every transfer of a licence or permit granted under the Act may be made either by endorsement on the licence or permit or by cancellation of the licence or permit and issuing a new licence or permit.

11 Duties of holders of licences and permits.

11. The Notice required by sub-section (1) (a) of section 11 of the Act to be sent to the Minister of any transfer, devolution, loan, lease, or hiring or the castration or death of a bull shall be in the form C in the Schedule to these Regulations and shall contain the particulars mentioned in that form and shall be so sent within three days after the making of the transfer, devolution, loan, lease, or hiring, or the happening of the castration or death.

12 Requisition for examination by a referee.

12. Every application under sub-section (1) of section 15 of the Act to have a bull inspected and examined by a referee shall be made to the Minister in writing in the form D in the Schedule to these Regulations and shall be made within fourteen days after the refusal, revocation, or suspension, or the service of the notice in respect of which the application is made, and the fee payable on such application shall be one pound.

13. Notice under sub-section (1) of section 13 of the Act shall be in the form or to the effect stated at E in the Schedule to these Regulations.

14 Import of bulls.

14. In the case of a bull lawfully imported into Saorstát Eireann, the prescribed time within which an application may be made for a licence to keep and have possession of the bull shall be the period commencing on the date on which the bull is imported into Saorstát Eireann and terminating at midnight of the seventh day immediately following that on which the bull is so imported.

15 Form of notice.

15. (1) Any notice required or authorised by these Regulations shall be in writing.

(2) Any notice required or authorised by these Regulations to be served shall be deemed to be sufficiently served if it is sent by post addressed to the person to be served at his last known place of abode or business and service shall be deemed to be made at the time at which the notice would be delivered in the ordinary course of post.
