THE UNEMPLOYMENT INSURANCE (INSURANCE INDUSTRY SPECIAL SCHEME) AMENDMENT ORDER (No. 2), 1924.

UNEMPLOYMENT INSURANCE.

THE UNEMPLOYMENT INSURANCE (INSURANCE INDUSTRY SPECIAL SCHEME) AMENDMENT ORDER (No. 2), 1924, made by the Minister for Industry and Commerce under the Unemployment Insurance Act, 1920 (10 & 11 Geo. V. c. 30) and the Unemployment Insurance Act, 1924 (No. 26 of 1924).*

WHEREAS it is provided by Sub-section 2 of Section 8 of the Unemployment Insurance Act, 1924 , that for the purpose of securing in the case of a Special Scheme that like rates of benefit shall be payable to the persons to whom the Scheme applies as are payable under that Act, and that the benefits under the Scheme shall otherwise be not less favourable than those provided by the general provisions of the Unemployment Insurance Acts, 1920-1924 (but for no other purpose), the Minister for Industry and Commerce may, after consultation with the body charged with the administration of the scheme, notwithstanding anything in Section 18 of the Unemployment Insurance Act, 1920, by order vary or amend the provisions of the Scheme, and any such order may provide for consequential amendments as to rates of contributions and otherwise:

AND WHEREAS the provisions of the Insurance Industry Unemployment Insurance Scheme have been varied and amended by the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924:

AND WHEREAS for the purposes specified in the said Subsection 2 of Section 8 of the Unemployment Insurance Act, 1924 , it is expedient further to vary and amend the said Scheme.

AND WHEREAS the Incorporated Insurance Industry Unemployment Insurance Board has been consulted with reference to the variations and amendments set out in the schedule hereto, and has approved thereof.

NOW, THEREFORE, the Minister for Industry and Commerce, pursuant to Sub-section 2 of Section 8 of the Unemployment Insurance Act, 1924 , and in exercise of all other powers enabling him in that behalf doth hereby make the following Special Order:

*This Order having lain before both Houses of the Oireachtas for twenty days, in accordance with Section 36 (2) of the Unemployment Insurance Act, 1920, duly came into force.

1. The Insurance Industry Unemployment Insurance Scheme, as varied and amended by the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924, shall be further varied and amended in the manner set forth in the Schedule hereto.

2. This Order may be cited as the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order (No. 2), 1924, and may with the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924, be cited together as the Unemployment Insurance (Insurance Industry Special Scheme) Orders, 1924.

SCHEDULE.

VARIATIONS AND AMENDMENTS OF THE INSURANCE INDUSTRY UNEMPLOYMENT INSURANCE SCHEME, AS VARIED AND AMENDED BY THE UNEMPLOYMENT INSURANCE (INSURANCE INDUSTRY SPECIAL SCHEME) AMENDMENT ORDER, 1924.

I.—Paragraph (5) of Article 7 as amended by the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924, shall be deleted, and the following paragraph substituted:—

"For the purpose of retaining in insurance under the special scheme soldiers enlisted on short service who before enlistment were persons insured under the scheme, such contributions under the scheme shall be deemed to have been paid in respect of each such person to whom this paragraph applies, as are necessary to secure that there shall be not less than 24 contributions under the scheme to the credit of such person in respect of each Insurance Year during which or part of which such person has been a person to whom this paragraph applies. This paragraph shall apply to every person enlisted in the military forces of Saorstát Eireann for a period of service which terminates on or before the 29th day of June, 1924, who in respect of employment before the date of enlistment has had paid for him either 20 contributions under the Unemployment Insurance Acts or the scheme at any time or 10 contributions under the Unemployment Insurance Acts or the scheme since the 8th day of November, 1920.

II.—Notwithstanding anything contained in paragraph 2 of the Second Schedule as varied and amended by the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924, there shall during the Benefit Year beginning on the 16th day of October, 1924, and ending on the Wednesday nearest to the 16th day of October, 1925, be payable to claimants for out-of-work benefit under the scheme a maximum of 33 weeks' benefit.

III.—The proviso to paragraph 3 of the Second Schedule, as varied and amended by the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924, shall be deleted, and there shall be substituted therefor the following:—

"Provided that for the purpose of determining the amount of out-of-work benefit to which, having regard to the aforesaid proportion, any person is entitled, but for no other purpose, no account shall after the 15th day of October, 1924, being the last day of the First Benefit Year for the purposes of the Scheme, be taken of any unemployment benefit or out-of-work benefit which may have been received by such person between the 7th day of November, 1920, and the commencement of the Second Benefit Year."

IV.—Notwithstanding anything contained in the Scheme as varied and amended by the Unemployment Insurance (Insurance Industry Special Scheme) Amendment Order, 1924, Condition (i) of Sub-section (1) of Section 7 of the Unemployment Insurance Act, 1920, shall not operate or have effect during the Second Benefit Year, and notwithstanding the provisions of Sub-section (4) of Section 8 of the Unemployment Insurance Act, 1920, no person shall during the Second Benefit Year be disqualified for receiving out-of-work benefit by reason only of the fact that no contributions have been paid in respect of him during any Insurance Year.

V.—For the purpose of reciprocal and other arrangements respecting the scheme which may be made by the Minister under Section 10 of the Unemployment Insurance Act, 1924 , the body charged with the administration of the scheme may negotiate with the bodies charged with the administration of special schemes for the Insurance Industry in Great Britain and Northern Ireland.
