THE ENDOWMENT FUND (FINAL WINDING-UP) ORDER, 1925.

The following Order, namely :

ENDOWMENT FUND (FINAL WINDING-UP) ORDER, 1925.

No. 20 of 1925.

WHEREAS by Section 10 of the Ministers and Secretaries Act, 1924 . (No. 16 of 1924). it is enacted that wherever the expenses or any part of the expenses of any public service assigned by or under that Act to any Department of State were at the date of the passing of that Act payable out of any specific departmental or other public funds other than the Central Fund or moneys provided by the Oireachtas, or any specific departmental or other public funds other than as aforesaid were at the date of the passing of that Act applicable to or towards the discharge of the expenses or any part of the expenses of any such public service, it shall be lawful for the Executive Council by Order to make all such apportionments of public funds as may be rendered necessary by reason of the allotment by that Act of different portions of any such public service to different Departments of State, and to provide for the winding-up and the payment into or disposal for the benefit of the Exchequer, in such manner as the Minister for Finance may appoint, of the whole or any part of the specific departmental or other public funds out of which such expenses or any part thereof had theretofore been payable or which had theretofore been applicable in or towards the discharge of such expenses or any part thereof as aforesaid, and to declare that such expenses shall thereafter be paid out of moneys provided by the Oireachtas:

AND WHEREAS by the said Ministers and Secretaries Act, 1924 , the public services of the Department of Agriculture and Technical Instruction for Ireland in relation to technical instruction were allotted to the Department of Education and in relation to fisheries were allotted to the Department of Fisheries and the other public services of the said Department of Agriculture and Technical Instruction for Ireland were allotted to the Department of Lands and Agriculture:

AND WHEREAS at the date of the commencement of the Ministers and Secretaries Act, 1924 , the fund known as the Endowment Fund and established under Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899, was applicable to or towards the discharge of the expenses of the Department of Agriculture and Technical Instruction for Ireland:

AND WHEREAS by the Endowment Fund (First Apportionment and Winding-up) Order, 1925, and the Endowment Fund (Second Apportionment and Winding-up) Order, 1925, provision was made for the partial winding-up of the said Endowment Fund, and the said Endowment Fund, as remaining after the operation of the said two Orders consists of the several sums of stock, annual sums, and annual grants stated in the Schedule to this Order:

AND WHEREAS it is expedient that provision should be made for the completion of the winding-up and disposal of the said Endowment Fund and for the disposal of the cash balance standing to the credit thereof on the 31st day of March, 1925:

NOW, the Executive Council of Saorstát Eireann in exercise of the powers conferred on them by the said Section 10 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), and of every and any other power them in this behalf enabling, do hereby order as follows:

1. This Order may for all purposes be cited as the Endowment Fund (Final Winding-Up) Order, 1925. (No. 20 of 1925.)

2. The Interpretation Act, 1923 (No. 46 of 1923), shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The winding-up of the Endowment Fund shall be completed and the said Fund shall be finally wound up as on and from the 31st day of March, 1925, and the cash balance standing on that day to the credit of the said Fund (including all cash owing to, but not actually paid into the said Fund), shall be paid into or disposed for the benefit of the Exchequer in such manner as the Minister for Finance may appoint.

4. The several sums of stock mentioned in Part I of the Schedule to this Order shall be disposed of for the benefit of the Exchequer at such times and in such manner as the Minister for Finance may appoint.

5. The several annual sums mentioned in Part II of the Schedule to this Order shall during the financial year ending on the 31st day of March, 1926, and during every subsequent financial year, be paid into or disposed for the benefit of the Exchequer in such manner as the Minister for Finance may appoint.

6. The several annual grants mentioned in Part III of the Schedule to this Order shall cease to be made from and after the end of the financial year ending on the 31st day of March, 1925.

7. The expenses of the public services of the Department of Agriculture and Technical Instruction for Ireland allotted as aforesaid to the Department of Lands and Agriculture shall from and after the 31st day of March, 1925, be paid out of moneys provided by the Oireachtas.

8. Nothing in this Order shall prejudice or affect the liability to the Guarantee Fund under the Land Purchase Acts of any of the moneys dealt with by this Order

PART II.

1. £40,650 being the balance remaining after the apportionments made by the Local Taxation (Customs and Excise) Duties Grant Order, 1924, and the Endowment Fund (Second Apportionment and Winding-Up) Order, 1925, of the annual sum payable out of the Local Taxation Account and placed at the disposal of the Department of Agriculture and Technical Instruction for Ireland by paragraph (a) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899.

2. £14,000 being the balance remaining after the apportionments made by the Irish Church Temporalities (Apportionment of Fund) Order, 1924, and the Endowment Fund (First Apportionment and Winding-Up) Order, 1925, of the annual sum payable out of the surplus of the Church Temporalities Fund and placed at the disposal of the Department of Agriculture and Technical Instruction for Ireland by paragraph (b) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899.

3. £4,000 being the annual sum fixed by the Estate Duty Grant (No. 1) Order, 1924, as the amount of the annual sum payable to the Department of Agriculture and Technical Instruction for Ireland under Sub-section (1) of Section 3 of the Probate Duties (Scotland and Ireland) Act, 1888, as amended by Section 1 of the Agriculture and Technical Instruction (Ireland) (No. 2) Act, 1902.

PART III.

1. £9,600 being the annual sum fixed by the Judicial Savings (Apportionment of Grant) Order, 1924, as the amount of the annual sum payable out of moneys provided by the Oireachtas and placed at the disposal of the Department of Agriculture and Technical Instruction for Ireland by paragraph (d) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899.

2. £4,800 being the annual sum fixed by the Agricultural Education (Apportionment of Grant) Order, 1924, as the amount of the annual sum payable out of moneys provided by the Oireachtas and placed at the disposal of the Department of Agriculture and Technical Instruction for Ireland by paragraph (f) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899.
