THE RATES ADVISORY COMMITTEE ORDER, 1925.

WHEREAS by Section 7 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), it is enacted that whenever any statutory board of commissioners or other statutory board or body exercising any function of government or discharging any public duties in relation to public administration was in existence on the 6th day of December, 1921, and had jurisdictions, powers or duties extending to the whole of the late United Kingdom, the Executive Council may, by order, establish a board of commissioners to exercise in Saorstát Eireann the functions which were on the 6th day of December, 1921 exercisable by such statutory commissioners or statutory body as aforesaid in the area now comprised in Saorstát Eireann, and that whenever the Executive Council establishes under that section any board of commissioners, the Executive Council shall, by the order establishing such board, apply to such board with such adaptations and modifications as may be necessary the several British Statutes regulating the board of commissioners or other body whose jurisdictions, powers or duties are by such order conferred or imposed on such board.

AND WHEREAS the Rates Advisory Committee constituted under Section 21 of the Ministry of Transport Act, 1919 (9 & 10 Geo. 5, ch. 50), is a statutory body exercising functions of government or discharging public duties in relation to public administration, and was in existence on the 6th day of December, 1921, and had jurisdictions, powers and duties relating to the whole of the late United Kingdom. AND WHEREAS it is expedient to make provision for the exercise in Saorstát Eireann of the functions which on the 6th day of December, 1921, were exercisable under the Harbours, Docks and Piers (Temporary Increase of Charges) Act, 1920 (10 & 11 Geo. 5, ch. 21), by the Rates Advisory Committee in the area now comprised in Saorstát Eireann.

NOW the Executive Council, in exercise of the powers conferred on them by Section 7 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may for all purposes be cited as the Rates Advisory Committee Order, 1925.

2. The Interpretation Act, 1923 , applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. A Committee to be called and known as the Rates Advisory Committee (hereinafter called the Committee) is hereby established to exercise in Saorstát Eireann all the functions which were on the 6th day of December, 1921, exercisable under the Harbours, Docks and Piers (Temporary Increase of Charges) Act, 1920, in the area now comprised in Saorstát Eireann by the Rates Advisory Committee constituted under Section 21 of the Ministry of Transport Act, 1919.

4. (1)—The Committee shall consist of five persons appointed by the Minister for Industry and Commerce (hereinafter called the Minister) ; (2) The Chairman of the Committee shall be such member of the Committee as the Minister shall from time to time nominate ; (3) Any vacancies in the Committee from death, resignation or otherwise, shall be filled by appointment made by the Minister.

5. (1)—Subject to the provisions of this Order all the jurisdictions, powers and duties which were on the 6th day of December, 1921, conferred or imposed on the Rates Advisory Committee constituted under Section 21 of the Ministry of Transport Act, 1919, for the purpose of their functions under the Harbours, Docks, and Piers (Temporary Increase of Charges) Act, 1920, are hereby conferred and imposed on the Committee ; (2) Any references in the Harbours, Docks and Piers (Temporary Increase of Charges) Act, 1920, to the Rates Advisory Committee constituted under Section 21 of the Ministry of Transport Act, 1919, shall be construed as references to the Committee.

6. Sub-section (5) of Section 21 of the Ministry of Transport Act, 1919, shall not apply to the members of the Committee.
