14/11/1924: Civil Service - Sick Leave Modified (Military Service) Certificate


REGULATION No. 2, MADE BY THE MINISTER FOR FINANCE UNDER SECTION 9 OF THE CIVIL SERVICE REGULATION ACT, 1924.

1. In the application of the Sick Leave Rules laid down from time to time for permanent established Civil Servants to the case of persons serving in the Civil Service of the Government of Saorstát Éireann, who are holders of " Modified (Military Service) Certificates," issued by the Civil Service Commissioners under Regulation No. 2, made by them, with the consent of the Minister for Finance, under Section 5 of the Civil Service Regulation Act, 1924 , the following modification shall be made, viz. :—

That for the first five years of service after the date of the " Modified (Military Service) Certificate", any civil pay allowed during sick leave in excess of three months in the aggregate in any year shall be reduced to such amount as, with any pension or allowances payable by the Ministry of Defence in respect of the period of sick leave, will not exceed the full civil pay of the office in respect of that period.

3. Provided that in the case of an officer who, if he had retired on the ground of ill-health at the commencement of the period of sick leave, would have been qualified for a pension, if the amount of the reduced civil pay during sick leave is less than the pension which, if he had so retired, would have been payable to him in respect of the period of sick leave, it may, with the consent of the Minister for Finance, be increased to an amount not exceeding the amount of such pension.
