31/01/1924: The Local Offices and Employments Order, 1924.


MINISTRY OF LOCAL GOVERNMENT.

WHEREAS by Section 15 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter called "the Act") it is enacted as follows:—

(1) The Minister for Local Government shall have with respect to all persons now employed or hereafter to be employed by any Local Authority in any office or employment to which this section applies and with respect to the accounts of such persons all the same powers as he now has by law with respect to officers of Boards of Guardians of Poor Law Unions, and the accounts of such officers respectively.

(2) This section shall apply to such offices and employments as the Minister for Local Government shall from time to time by Order prescribe.

AND WHEREAS by the Local Officers and Employees No. 1 Order, 1923, I, the Minister for Local Government, did prescribe the offices and employments to which the above recited section should apply and did apply the orders, rules and regulations mentioned therein to the persons appointed to the said offices and employments:

NOW THEREFORE I, the Minister for Local Government, in pursuance of the powers vested in me by the above recited section and all other powers thereto enabling me, do hereby order and prescribe as follows:—

1. In this Order, unless the context otherwise requires, all expressions shall have the same meaning as in the Act.

2. From and after the date hereof, the Local Officers and Employees No. 1 Order, 1923, shall cease to have effect.

3. Section 15 of the Act shall apply to the offices or employments under any Local Authority set out in the schedule to this Order, hereinafter referred to as "the prescribed offices or employments."

4. All orders, rules and regulations now in force, governing the mode of appointment of paid officers in Unions, their salaries, continuance in office, security, suspension, dismissal and resignation, and the filling up of vacancies shall apply with the necessary modifications to persons appointed to the prescribed offices or employments in the same manner as they apply to paid officers of Boards of Guardians, subject to such alterations, additions, and omissions as the Minister for Local Government may from time to time direct either generally or in the case of any one of the prescribed offices or employments or of any particular local authority.

5. The powers given by this Order to the Minister for Local Government shall be in addition to and not in derogation of any other powers of the said Minister in respect of the prescribed offices or employments.

6. This Order may be cited as "The Local Offices and Employments Order, 1924."

SCHEDULE.

1. Any office or employment which is remunerated wholly or in part by way of annual salary.

2. Any office or employment the duties of which are, wholly or in part, professional or clerical.

3. Any office or employment the duties of which include the supervision or control of any person or persons employed by the Local Authority.

4. Any office or employment the duties of which include or relate to the receipt or disbursement of any moneys for or on behalf of the Local Authority.

5. Any office or employment the duties of which include or relate to the issuing of licenses to drive motor cars or use mechanically propelled vehicles on roads.
