The Agricultural Grant (Adaptation) Order, 1924.

THE AGRICULTURAL GRANT (ADAPTATION) ORDER, 1924.

WHEREAS it is provided, amongst other things, by Section 20 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act of 1923") that I, the Minister for Local Government and Public Health, may by order make such adaptations of any existing enactment relating to any matter dealt with or affected by the Act as appear to me necessary or expedient for carrying into effect the Act or the County Schemes made thereunder:

AND WHEREAS by Section 21 of the Act of 1923 the expression "existing enactments" means enactments in force in Saorstát Eireann at the date of the passing of the Act:

AND WHEREAS by the several County Schemes as given the force of law by or as confirmed or amended by me, the said Minister, under or in pursuance of the Act of 1923 boards of guardians have been abolished in the several counties or county boroughs to which such schemes respectively relate, and their powers and duties transferred to county boards of health established under such schemes, which, amongst other things, provide that the expenses of such county boards of health shall be raised by means of the poor rate as a county-at-large charge or equally over the districts of such county boards of health:

AND WHEREAS Section 51 of the Local Government (Ireland) Act, 1898 (hereinafter referred to as "the Act of 1898") is an existing enactment within the meaning of Section 20 of the Act of 1923, which is affected by the Act of 1923, and it appears to me, the said Minister, necessary and expedient for carrying into effect the Act of 1923 or the county schemes made thereunder to make the adaptations hereinafter appearing in the said Section 51 of the Act of 1898, in order to provide for the application of the sum formerly payable out of the agricultural grant in respect of union charges in a county to which a county scheme relates:

NOW, THEREFORE, I, the Minister for Local Government and Public Health, in exercise of the powers given to me by Section 20 of the Act of 1923, do by this my Order, order as follows:—

1. The Adaptation (Agricultural Grant) Order, 1924, is hereby revoked, but without prejudice to the validity of anything done or remaining to be done in continuance of steps already duly taken thereunder.

2. Section 51 of the Act of 1898 shall be adapted as follows :—

(i) In sub-sections (2) and (3) of the said section references to "union charges" and to a "union" shall respectively be construed so as to include references to "county board of health charges" and to a "county health district";

(ii) Sub-section (4) of the said section shall be adapted by the addition of the following paragraph (c) after paragraph (b) thereof: "(c) where the amount is to be raised for county board of health charges, then in respect of union charges in the former unions in the county comprised within the county health district";

(iii) In paragraph (b) of sub-section (9) of the said section the reference to a "board of guardians" shall be construed so as to include a reference to a "county board of health".

3. In the Adaptations made by this Order in the said Section 51 of the Act of 1898 :—

(i) The expression "county board of health" means a county board of health established under a county scheme made under or in pursuance of the Act of 1923;

(ii) The expression "county board of health charges" means charges required to be raised by means of the poor rate to defray the expenses of a county board of health;

(iii) The expression "county health district" means the area of administration of a county board of health.

4. This Order may be cited as the Agricultural Grant (Adaptation) Order, 1924.
