THE TEACHERS' PENSION RULES, 1924.

Rules made by the Minister for Education with the consent of the Minister for Finance, under Section 11 (Eleven) of the National School Teachers (Ireland) Act, 1879, in relation to the pensions of certain National School Teachers.

I, Eoin MacNeill, Minister for Education, in exercise of the power given to me by the National School Teachers (Ireland) Act, 1879, and of every power me thereunto enabling, do hereby make the following Rules:—

1. Where a teacher transfers his service with or without a break from a school in the jurisdiction of the Government of Northern Ireland to a school in the jurisdiction of the Government of Saorstát Éireann, the service of such teacher prior to transfer shall be reckoned as service for the purposes of the Rules made under the National School Teachers (Ireland) Act, 1879, provided that the Ministry of Finance of Northern Ireland pays to the Superintendent a sum equal to four times the amount of all pension premiums to the credit of the teacher, together with compound interest at the rate of two and a half per cent. annum on each premium payment reckoned up to the date on which such teacher came under the jurisdiction of the Government of Saorstát Éireann.

2. Where a teacher transfers his services with or without a break from a school in the jurisdiction of the Government of Saorstát Éireann to a school in the jurisdiction of the Government of Northern Ireland, the Superintendent shall pay from the Teachers' Pension Fund to the Ministry of Finance of Northern Ireland a sum equal to four times the amount on all pension premiums to the credit of the teacher, together with compound interest at the rate of two and a half per cent. annum on each premium payment reckoned up to the date on which such teacher comes under the jurisdiction of the Government of Northern Ireland.

3. Where a teacher who has been dismissed or has retired under the conditions of Rule 13 (4) of the Rules of 1914, or Rule 11 (2) of the Rules of 1897 from the service under the jurisdiction of the Government of Northern Ireland, enters the service under the jurisdiction of the Government of Saorstát Éireann, such teacher may pay to the Superintendent, with compound interest at the rate of two and a half per cent. per annum, any sum repaid to him by the Ministry of Finance of Northern Ireland on such dismissal or retirement, and his service prior to dismissal or retirement shall in that case be reckoned as service for the purposes of the Rules made under the National School Teachers (Ireland) Act, 1879.

4. Where a teacher who has retired from the service under the jurisdiction of the Government of Northern Ireland with a pension enters the service under the jurisdiction of the Government of Saorstát Éireann, the service of such teacher prior to such retirement shall be reckoned as service for the purposes of the Rules made under the National School Teachers (Ireland) Act, 1879, provided that the Ministry of Finance of Northern Ireland pays to the Superintendent a sum calculated as in Rule 1 of these Rules, but diminished by a sum equal to the total pension payments made, together with compound interest on each several pension payment reckoned at the same rate and up to the same date as in the case of the premium payments.

5. Where a teacher who has retired from the service under the jurisdiction of the Government of Saorstát Éireann with a pension enters the service under the jurisdiction of the Government of Northern Ireland, his pension shall cease, and the Superintendent shall pay from the Teachers' Pension Fund a sum calculated as in Rule 2 of these Rules, but diminished by a sum equal to the total pension payments made together with compound interest on each several pension payment reckoned at the same rate and up to the same date as in the case of the premium payments.

6. All sums payable or receivable by the Superintendent under Rules 1, 2, 4, or 5 of these Rules shall be charged or credited as the case may be as to one-fourth to the Teachers' Contribution Account, and as to three-fourths to the Endowment Account.

7. All sums receivable by the Superintendent under Rule 3 of these Rules shall be credited to the Teacher's Contribution Account.

8. In these Rules the expression " Superintendent " means the Superintendent of the Teachers' Pension Office of Saorstát Éireann.

9. These Rules shall have effect as from the 1st day of February, 1922.
