ARREARS AMENDMENT REGULATIONS (No. 2), 1924.

REGULATIONS, DATED 10th DECEMBER, 1924, MADE BY THE IRISH INSURANCE COMMISSIONERS, WITH THE CONCURRENCE OF THE MINISTER FOR LOCAL GOVERNMENT AND PUBLIC HEALTH, UNDER THE NATIONAL HEALTH INSURANCE ACTS, 1911 TO 1924.

THE Irish Insurance Commissioners, in exercise of the powers conferred on them by the National Health Insurance Acts, 1911 to 1924, and of all-other powers enabling them in that behalf, do hereby, with the concurrence of the Minister for Local Government and Public Health, make the following Regulations:—

1. These Regulations may be cited as the National Health Insurance (Arrears) Amendment Regulations (No. 2), 1924,* and shall be included amongst the Regulations which, by Article 1 of the National Health Insurance (Arrears) Amendment Regulations, 1924, may be cited together as the National Health Insurance (Arrears) Regulations, 1921 to 1924.

2. Notwithstanding anything contained in Articles 11 and 12 of the National Health Insurance (Arrears) Regulations, 1921, hereinafter referred to as the Principal Regulations, in the case of the contribution year ending on the 6th day of July, 1924, the period of grace shall be the period up to and including the 30th day of November, 1924, or, in the case of employed contributors, such longer period as the Irish Insurance Commissioners may in any particular case determine, and the date before which notices of arrears must be sent or delivered shall be the 1st day of October, 1924, and those articles shall have effect as regards the contribution year ending on the 6th day of July, 1924, accordingly.

3. (1) For the purposes of the Principal Regulations, a Society shall treat any member, being an employed contributor, who entered into insurance on or before the 31st day of December, 1920, and who has satisfied the conditions specified in paragraph (b) of sub-section (2) of Section 1 of the National Health Insurance (Prolongation of Insurance) Act, 1921, and by or in respect of whom less than 27 contributions were paid for the contribution year ending on the 6th day of July, 1924, as though the number of such contributions had been 27.

(2) For the purposes of this Article a member who, by virtue either of the National Health Insurance (Arrears) Amendment Regulations, 1922, or of the National Health Insurance (Arrears) Amendment Regulations, 1923, or of the National Health Insurance (Arrears) Amendment Regulations, 1924, was treated as though the number of contributions paid by or in respect of him had been 26 for the preceding contribution year, shall be deemed to have satisfied the conditions specified in paragraph (b) aforesaid.

* These Regulations supersede the Provisional Regulations entitled the National Health Insurance (Arrears) Amendment Regulations (No. 2), 1924, which were made, and came into force, on the 3rd September, 1924.

4. In the case of a member, being an employed contributor, who was continuously in insurance from the 2nd July, 1923, up to the 6th day of July, 1924, and by or in respect of whom less than 27 contributions were paid for the contribution year ending on the 6th day of July, 1924, the Society shall for the purpose of the Principal Regulations treat him as though the number of such contributions had been 27, subject, however, to the condition that the Society is satisfied, or in the case of a dispute it is decided in manner provided by the National Insurance Act, 1911, that for the weeks of the said contribution year for which contributions were not paid such member was, except when incapable of work by reason of some specific disease or some bodily or mental disablement, available for, but unable to obtain, employment.

5. Unless by reason of special circumstances the Irish Insurance Commissioners may otherwise determine in any particular case, Articles 3 and 4 of these Regulations shall not apply to any member until contribution cards to which stamps have been duly affixed in respect of any period of employment comprised in the contribution year ending on the 6th day of July, 1924, have been surrendered by him to the Society.

6. Article 6 of the National Health Insurance (Arrears) Amendment Regulations, 1924, shall apply and shall be deemed always to have applied to members of the armed forces of Saorstát Éireann as defined in Section 25, sub-section (1) of the National Health Insurance Act, 1923 , as amended by Section 5 of the National Health Insurance Act, 1924 .

7. In these Regulations reference to " 27 contributions " shall not, by virtue of Article 6 of the Principal Regulations, be read as if that number were increased by 1.
