STATUTORY RULES AND ORDERS. 1924. No. 22.

IRISH CHURCH TEMPORALITIES FUND (APPORTIONMENT OF GRANT) ORDER, 1924.

WHEREAS by Section 9 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922) it is enacted that wherever under any British Statute any grant, whether annual or capital, is directed to be made by the Treasury out of the Consolidated Fund or by the Treasury or any other Government Department out of any other fund, and the amount of such grant is by such Statute fixed either for the whole of the late United Kingdom or for any part thereof which included the area now comprised in Saorstát Eireann, the Minister for Finance may by order apportion such amount between Saorstát Eireann and the rest of the area in respect of which such amount is fixed as aforesaid and may by such order fix the amount of such grant to be made under such Statute in Saorstát Eireann :

AND WHEREAS by paragraph (b) of Section 15 of the British Statute entitled the Agriculture and Technical Instruction (Ireland) Act, 1899, it is enacted that there should be placed at the disposal of the Department of Agriculture and Technical Instruction (in this Order called " the Department ") for the purposes of Part II. of that statute during a period of fifteen years from the commencement of that statute an annual sum of seventy thousand pounds to be paid out of the annual income derivable from the surplus of the Irish Church Temporalities Fund, and that thereafter during each subsequent period of fifteen years there should be placed at the disposal of the Department out of the annual income derivable from the Irish Church Temporalities Fund such annual sum as in the opinion of the Treasury could be so paid without impairing the security for any liabilities existing at the commencement of that Act upon that fund:

AND WHEREAS by a declaration in writing made on the 17th day of December, 1914, in pursuance of paragraph (b) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899, the Treasury declared that in their opinion the Irish Church Temporalities Fund would be in a position to bear a continuance of the then existing annual charge of seventy thousand pounds for the period of fifteen years, commencing on the 1st day of April, 1915 ;

AND WHEREAS the said annual sum of seventy thousand pounds was fixed by the Treasury as aforesaid for the whole of Ireland, being a part of the late United Kingdom, which included the area now comprised in Saorstát Eireann, and it is necessary that such sum should be apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was so fixed, and that the annual sum to be placed at the disposal of the Department under the said paragraph (b) of Section 15 of the Statute aforesaid in Saorstát Eireann should be fixed :

NOW, I, EARNÁN DE BLAGHD, Minister for Finance in Saorstát Eireann, in exercise and by virtue of the power in this behalf vested in the Minister for Finance by the Adaptation of Enactments Act, 1922 (No. 2 of 1922) and of every and any other power me in this behalf enabling, do hereby order as follows :—

1. The annual sum of £70,000 (seventy thousand pounds) fixed by the Treasury pursuant to paragraph (b) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899, as the sum to be placed at the disposal of the Department for the purposes of Part II. of that Act during the period of fifteen years commencing on the 1st day of April, 1915, and to be paid out of the annual income derivable from the surplus of the Irish Church Temporalities Fund is hereby apportioned between Saorstát Eireann and the rest of the area in respect of which the said sum was fixed by the Treasury as follows, that is to say :—

(a) in respect of Saorstát Eireann, the sum of £56,000 (fifty-six thousand pounds), and

(b) in respect of the rest of the area aforesaid, the sum of £14,000 (fourteen thousand pounds).

2. The annual sum to be placed in Saorstát Eireann at the disposal of the Department under the said paragraph (b) of Section 15 of the Agriculture and Technical Instruction (Ireland) Act, 1899, until the expiration of the said period of fifteen years, commencing on the 1st day of April, 1915, shall be the sum of £56,000 (fifty-six thousand pounds).

3. In this Order the expression " Saorstát Eireann " means the area for the time being within the jurisdiction of the Parliament and Government of Saorstát Eireann.

4. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

5. This Order may for all purposes be cited as the Irish Church Temporalities Fund (Apportionment of Grant) Order, 1924.
