COUNTY SCHEME ORDER, MONAGHAN NO. 2, 1923.

THE LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923 .

To the Council of the Administrative County of Monaghan; to the Monaghan County Board of Health; and to all whom it may concern:

WHEREAS it is enacted by Section 5 of the Local Government Temporary Provisions) Act, 1923 , hereinafter referred to as the Act, as follows:—

1. The Minister, by order made under this Section, may from time to time amend or modify any County Scheme after it has come into operation in any way he may deem necessary and every such amendment or modification shall come into operation as from such date as the Minister shall by such Order direct.

4. This Section applies as well to existing County Schemes as to County Schemes submitted and confirmed under this Act.

AND WHEREAS by Setion 21 of the Act, the word "Minister" is defined to mean the "Minister for Local Government".

AND WHEREAS it is provided in effect amongst other things by sub-section (I) of section 7 of the Act that a County Scheme may provide for the abolition of any County Hospital Committee or County Infirmary Committee or any other body existing in the county to which the County Scheme relates and exercising functions connected with the relief of the poor in that county and for the transfer of their powers and duties to a County Board of Health:

AND WHEREAS by the Monaghan County Scheme Order, 1923, I, the Minister for Local Government, in pursuance of the said Section 5 of the Act, did amend and modify the existing County Scheme for the Administrative County of Monaghan, in such way as to bring it into conformity with the provisions set out in the schedule to the said Order, and did substitute the said provisions for the provisions of the said existing County Scheme (which said first mentioned provisions are hereinafter referred to as the Monaghan County Scheme):

AND WHEREAS the Monaghan County Scheme has come into operation, and I, the Minister for Local Government, deem it necessary to amend the said Scheme in manner hereinafter appearing and have given to the Council of the Administrative County of Monaghan, one month's notice of my intention to make such amendment and have taken into consideration any representation which has been made to me by such Council within such month in respect of such amendment:

NOW, THEREFORE, I, the Minister for Local Government, in exercise of the powers given to me by sub-section (1) of Section 5 of the Act, the said month having expired, do by this My Order, order and direct as follows:—

1. The Monaghan County Scheme shall be and is hereby amended as follows:—

(a) sub-article (i) of article 15 of the said County Scheme shall be and the same is hereby revoked and the following sub-article shall be substituted therefor in the said Article 15 which shall be read and construed accordingly:

"15 (i) Subject to the provisions of this Scheme and to any directions of the Minister in that behalf, the Board of Health, shall provide and maintain for the reception and maintenance of persons in the County eligible for relief:—

(a) A County Home at Castleblayney for aged and infirm persons, chronic invalids, harmless lunatics, imbeciles, incurable cases of tuberculosis, and unmarried mothers.

(b) A County Hospital at Monaghan for the treatment of medical, surgical and maternity cases.

(c) A Fever Hospital at Monaghan for the treatment of cases of infectious and contagious diseases.

(d) A District Hospital at Carrickmacross for the treatment of Medical, Surgical and Maternity cases.

(e) A Fever Hospital at Carrickmacross for the treatment of cases of infectious and contagious diseases.

(f) With the approval of the Minister, such other institutions as they may deem desirable for the relief of the poor in their County."

(b) The schedule of bodies abolished which is annexed to the said County Scheme shall be amended by the addition thereto of the following:—

"5. The Joint Committee of Management of the Monaghan County Infirmary.

6. The Joint Committee of Management of the Monaghan Fever Hospital.

7. The Joint Committee of Management of the Carrickmacross Fever Hospital.

8. The Joint Committee of Management of the Clones Fever Hospital"

and article 12 of the said County Scheme shall be read and construed accordingly.

2. This amendment shall come into operation as from the First day of January, 1924.

3. This Order may be cited as the " Monaghan County Scheme (No. 2) Order, 1923".
