LAND ACT, 1923 - PROVISIONAL RULES

[Extract from Iris Oifigiúil of November 20, 1923.]

NOTICE is hereby given, in accordance with the provisions of the Rules Publication Act, 1893, that the Irish Land Commission propose to make the Rule set out in the Schedule hereto, the same having, by Order of the said Commission, bearing date the 19th day of November, 1923, been made to come into immediate operation as a Provisional Rule and to continue in force until a Rule shall have been made in accordance with the provisions of the Rules Publication Act.

And notice is hereby given, that copies of such Rules, as a Draft Rule under the same Act, may be purchased from Messrs. Eason and son, 40 and 41 Lower O'Connell Street, Dublin.

IRISH LAND COMMISSION.

PROVISIONAL RULE UNDER THE LAND ACT, 1923.

The Irish Land Commission after consultation with the President of the Incorporated Law Society of Ireland hereby certify that for the purpose of bringing the Land Act, 1923 , into operation it is necessary that the Rule set forth in the Schedule hereto should come into immediate operation and accordingly hereby Order pursuant to the power in that behalf conferred by section two of the Rules Publication Act, 1893, and all other powers them thereunto enabling, that such Rule come into operation forthwith as a Provisional Rule and continue in force until a Rule shall have been made in accordance with the provisions of the Rules Publication Act.

THE SCHEDULE REFERRED TO.

RULE UNDER THE LAND ACT, 1923 .

The 19th day of November, 1923.

In pursuance of the provisions of Section 76 of the Land Act, 1923 , the Land Commission, after consultation with the President of the Incorporated Law Society of Ireland, hereby Order that the following Rule shall from and after this date and until further Order be in force in relation to all proceedings for the purpose of carrying into effect the provisions of the said Act.

This Rule is in addition to the Provisional Rules made on the 18th day of August, 1923, the 18th day of September, 1923, and 26th day of September, 1923, and shall be read therewith.

LAND ACT, 1923 .

If for the purpose of the collection of compounded arrears of rent and payment in lieu of rent a landlord or tenant requires a judicial declaration as to whether any particular holding is one to which the Land Act, 1923 , applies or does not apply, he may apply to the Judicial Commissioner for a declaration that the holding is, or is not, as the case may be, one to which the said Act applies ; such application to be notified to the opposite party.
